HomeMy WebLinkAboutChapter 850 - Motorized Snow Vehicles STREET Chapter 850 MOTORIZED SNOW VEHICLES Article 1 INTERPRETATION 850.1.1 Highway- defined 850.1.2 Motorized snow vehicles - defined Article 2 OPERATION-PROHIBITED 850.2.1 Highway-under jurisdiction of City 850.2.2 Public lands - within city 850.2.3 Time-limitation Article 3 OPERATION-EXCEPTIONS 850.3.1 Exceptions -police- city employee- other Article 4 ENFORCEMENT 850.4.1 Fine- for contravention KITCHENER 850.1 JANUARY 1993 850.1.1 SNOW VEHICLES 850.3.1 Article 1 INTERPRETATION 850.1.1 Highway- defined "highway" includes a common and public highway, street, avenue, park- way,driveway,square,place,bridge,viaduct or trestle,any part of which is intended for,or used by the general public for the passage of vehicles,and in- cludes the area between the lateral property lines thereof. 850.1.2 Motorized snow vehicles-defined "motorized snow vehicles"means a self-propelled vehicle designed to be driven exclusively on snow or ice or both. Article 2 OPERATION-PROHIBITED 850.2.1 Highway-under jurisdiction of City No person shall operate a motorized snow vehicle upon any highway under the jurisdiction of the City. 850.2.2 Public lands-within city No person shall operate a motorized snow vehicle on any public lands within the City. 850.2.3 Time-limitation No person shall operate a motorized snow vehicle within the corporate limits of the City before 8 o'clock in the forenoon or after 11 o'clock in the after- noon of any day.By-law 87-260, 13 October, 1987. Article 3 OPERATION-EXCEPTIONS 850.3.1 Exceptions-police-city employee-other Nothing in this Chapter applies to prohibit the operation of a motorized snow vehicle: (a) by a member of the Waterloo Regional Police Services while engaged in the performance of the duty of a police officer; (b) by an employee of the City or of any of its Local Boards or Commissions while engaged in the performance of the duty of such employee,or (c) by an employee of the Chicopee Ski Club while engaged in the performance of the duty of such employee upon lands con- trolled by the Club. Article 4 ENFORCEMENT 850.4.1 Fine-for contravention Every person who contravenes any provision of this Chapter is guilty of an offence and is liable,upon conviction,to a fine not exceeding Five Thousand Dollars($5,000),exclusive of costs,for each offence,recoverable under the Provincial Offences Pict.
