945.1.2 WATER 945.2.1 <br /> 945.1.2 Water- sprinkling-time for <br /> No person shall water or sprinkle,or cause or permit the watering or sprin- <br /> kling of any lawn,garden,tree, shrub or other outdoor plant in the City of <br /> Kitchener through a hose or other attachment except between the hours of <br /> 7:00 a.m.and 10:00 a.m.,and between the hours of 7:00 p.m.and 11:00 p.m. <br /> subject to the following: <br /> (a) premises with municipal addresses having even numbers may <br /> sprinkle or water within the designated times only on even-num- <br /> bered calendar days; <br /> (b) premises with municipal addresses having odd numbers may <br /> sprinkle or water within the designated times only on odd-num- <br /> bered calendar days. <br /> 945.1.3 New sod-trees-gardens-lawn treatment-exception <br /> Notwithstanding Section 945.1.2,watering is permitted for the following: <br /> (a) newly planted sod, trees, ornamental shrubs and flower gardens <br /> while being installed and during the next following twenty-four <br /> hours after the completion of installation;and <br /> (b) lawns being treated with any pesticide,herbicide spray or fertilizer <br /> which requires water while being treated and during the next fol- <br /> lowing twenty-four hours after the application.By-law 90-74, 14 <br /> May, 1990. <br /> 945.1.4 Water supply emergency-Chapter suspended <br /> Notwithstanding the provisions of this Chapter,upon a Stage 2 or Stage 3 <br /> water supply emergency being declared by the Regional Municipality of <br /> Waterloo pursuant to its By-law 03-025,the operation of this Chapter shall <br /> be suspended and the provisions of the said Regional by-law shall govern.In <br /> the event of the Stage 2 or Stage 3 water supply emergency being declared at <br /> an end,the provisions stated in this Chapter shall apply.By-law 2003-154, <br /> 25 August,2003. <br /> Article 2 <br /> ENFORCEMENT <br /> 945.2.1 Fine-for contravention <br /> Every person who contravenes any provision of this Chapter is guilty of an <br /> offence and is liable,upon conviction,to a fine not exceeding Five Thousand <br /> Dollars($5,000),exclusive of costs,for each offence,recovered under the <br /> Provincial Offences Pict. <br /> JUNE 2004 945.2 KITCHENER <br />
