The Community and Infrastructure Services Committee met this date, commencing at 1:00 p.m.

1. CSD-17-069 - KITCHENER GROWTH MANAGEMENT STRATEGY
- 2017 ANNUAL MONITORING REPORT
The Committee considered Community Services Department report CSD-17-069, dated
August 31, 2017 regarding receipt of the 2017 Kitchener Growth Management Strategy and
providing the Monitoring Report to the Region of Waterloo. Ms. N. Goss and L. Nelson were in
attendance and responded to questions from the Committee.
Councillor K. Galloway-Sealock entered the meeting at this time.
On motion by Councillor F. Etherington -
it was resolved:
That Community Services Department report CSD-17-069 Kitchener Growth
Management Strategy 2017 Annual Monitoring Report be received and submitted to
the Regional Municipality of Waterloo in fulfilment of Clause 22.1 of the Administrative
Agreement between the City of Kitchener and the Region of Waterloo regarding
delegated approval authority
2. CSD-17-079 - CONTRACT SERVICES WITH THE ANIMAL WELFARE AGENCY OF
SOUTH CENTRAL ONTARIO
The Committee considered Community Services Department report CSD-17-079, dated
August 10, 2017 recommending approval of the animal services and dog licensing contract
with the Animal Welfare Agency of South Central Ontario. Ms. G. MacNeil and Ms. J. Sheryer
were in attendance and responded to questions from the Committee.
The following motion was voted on and was Carried Unanimously on a recorded vote.
On motion by Councillor F. Etherington -
it was resolved:
That the terms set out in Community Services Department report CSD-17-079 be
approved for the animal services and dog licensing contract with the Animal Welfare
Agency South Central Ontario and direct staff to prepare a contract in accordance with
such terms as well as the terms set out in C
which authorizes execution of such agreement; and,

2. CSD-17-079 - CONTRACT SERVICES WITH THE ANIMAL WELFARE AGENCY OF
SOUTH CENTRAL ONTARIO
That the Mayor and Clerk be authorized to execute an amendment to the Animal and
Dog Control and Pound Services Agreement dated January 1, 2014 with the Animal
Welfare Agency South Central Ontario to remove the requirement for the Humane
Society to remit $209,335. from 2016 dog licensing proceeds to the City; and further,
That staff be instructed to seek approval of the Director as designated by the Minister of
Agriculture, Food and Rural Affairs to change the redemption period for dogs back to
the statutory minimum of three days
3. INS-17-071 - SOUTH KITCHENER DISTRICT PARK, PHASE 1 - CONSULTANT FEE
INCREASE
The Committee considered Infrastructure Services Department report INS-17-071, dated
September 11, 2017 recommending an extension of the purchase order to Stantec Consulting
Ltd., for Phase 1 of the South Kitchener District Park. Ms. D. McGoldrick was in attendance
and responded to questions from the Committee.
In response to questions, Ms. C. Fletcher advised the relocation of the heritage house on the
subject property is still yet to be determined. She indicated the approval this date is to
reallocate funds from the projects contingency balance to the consultant account. She further
advised pending the decision on the relocation of the heritage home will determine whether the
entire purchase order increase allowance would be required. She noted any unspent funds
would remain with the overall project budget for the completion of the Park.
The following motion was voted on and was Carried on a recorded vote, with Councillors B.
Ioannidis, D. Schnider, P. Singh, S. Davey, S. Marsh, Z. Janecki, K. Galloway-Sealock and F.
Etherington voting in favour; and, Councillor J. Gazzola voting in opposition.
On motion by Councillor F. Etherington -
it was resolved:
That an extension of the purchase order to Stantec Consulting Ltd., the South
Kitchener District Park (Phase 1) in the amount of $355,000. plus H.S.T. be approved,
as outlined in Infrastructure Services Department report INS-17-071
4. INS-17-072 - ON-STREET PARKING REGULATIONS - OLD CHICOPEE DRIVE
The Committee considered Infrastructure Services Department report INS-17-072, dated July
13, 2017 recommending a parking prohibition at any time on the south side of Old Chicopee
Drive. Mr. K. Carmichael was in attendance and responded to questions from the Committee.
On motion by Councillor F. Etherington -
it was resolved:
That the Uniform Traffic Bylaw be amended to prohibit parking at any time on the south
(odd-numbered) side of Old Chicopee Drive between Kenora Drive and a point 35
metres east thereof, as outlined in Infrastructure Services Department report INS-17-
072
5. INS-17-073 - ON-STREET PARKING REGULATIONS - BLACKHORNE DRIVE
The Committee considered Community Services Department report CSD-17-069, dated
August 31, 2017 recommending parking be permitted for three consecutive hours on the west
side of Blackhorne Drive.
On motion by Councillor F. Etherington -
it was resolved:

5. INS-17-073 - ON-STREET PARKING REGULATIONS - BLACKHORNE DRIVE
That the Uniform Traffic Bylaw be amended to permit parking for three (3) consecutive
hours on the west (even-numbered) side of Blackhorne Drive from McLennan Park Gate
to Laurentian Drive, as outlined in Infrastructure Services Department report INS-17-
073
6. CSD-17-082 - NAMING OF A PRIVATE STREET
- 800 FAIRWAY ROAD NORTH
- WATERLOO REGION DISTRICT SCHOOL BOARD
The Committee considered Community Services Department report CSD-17-082, dated
August 25, 2017 regarding the acknowledgement of the Waterloo Region District School Board
in the naming of a private street located at 800 Fairway Road North. Mr. A. Pinnell was in
attendance and responded to questions from the Committee.
On motion by Councillor F. Etherington -
it was resolved:
That the City of Kitchener acknowledge that The Waterloo Region District School
Board proposes to name a private street within a mixed use development located at 800
Fairway Road North, as outlined in Community Services Department report CSD-17-
082; and further,
preparation and registration of the necessary By-law(s) for the naming of the private
street
7. CSD-17-084 - BY-LAW TO AUTHORIZE SECTION 37 AGREEMENTS UNDER THE
PLANNING ACT
The Committee considered Community Services Department report CSD-17-084, dated
August 30, 2017 recommending the authorization to execute agreements pursuant to Section
37(3) of the Planning Act. Mr. A. Pinard was in attendance and responded to questions from
the Committee.
On motion by Councillor F. Etherington -
it was resolved:
That the Mayor and Clerk be authorized to execute agreements pursuant to Section
37(3) of the Planning Act satisfactory to the City Solicitor, for the purpose of securing
the provision of facilities, services or matters given to the municipality in return for
increases in the height and density of development pursuant to Section 37(1) of the
Planning Act, as outlined in Community Services Department report CSD-17-084
8. CSD-17-083 - NOISE EXEMPTION REQUEST - KAWASAKI DISEASE
FUNDRAISING EVENT - VICTORIA PARK - SEPTEMBER 22, 2017
The Committee considered Community Services Department report CSD-17-083, dated
August 28, 2017 recommending approval of a noise exemption for the Kawasaki Disease
Fundraising Event to be held in Victoria Park on September 22, 2017. Ms. G. MacNeil was in
attendance and responded to questions from the Committee.
It was noted any recommendation arising from this matter would be considered at Special
Council later this date.
On motion by Councillor F. Etherington -
it was resolved:
That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code
be granted to the organizers of Kawasaki Disease Canada for the fundraising event
they will be holding in Victoria Park, on Friday September 22, 2017, between the
hours of 5:00 p.m. and 11:00 p.m

9. FCS-17-148 - APPEAL - ADULT ENTERTAINMENT PARLOUR - CLASS C-
LOCATED AT 2399 KINGSWAY DRIVE
The Committee considered Finance and Corporate Services Department report FCS-17-148,
dated August 11, 2017 regarding the denial or approval of The Love Shop to operate an Adult
Entertainment Parlour at 2399 Kingsway Drive. Ms. Fylactou was in attendance and
responded to questions from the Committee.
Mr. Ed Reiber, The Love Shop, addressed the Committee in support of opening a Class C -
Adult Entertainment Parlour retail location at 2399 Kingsway Drive. He indicated the shop is
similar to any other retail location; the only difference is that it sells adult goods. He stated the
only challenge to opening their establishment at this facility is a massage parlour located within
the minimum separation distance. He indicated he operates a Love Shop in another location
on Duke Street in Kitchener and further establishments in Waterloo and Cambridge. In
response to questions, Mr. Reiber acknowledged he would still require a subsequent Planning
Approval application to operate the business at the proposed location. He indicated the owner
has gone through other approval processes similar in nature in other municipalities and was
aware of the expense required to obtain the required planning approvals.
Questions were raised regarding the Zoning on the subject property; Ms. Fylactou advised the
property has been identified for rezoning through the Comprehensive Review of the Zoning By-
law (CRoZBy), but is not anticipated to be rezoned until sometime in 2018.
On motion by Councillor J. Gazzola -
it was resolved:
That the request of The Love Shop to operate an Adult Entertainment Parlour at 2399
Kingsway Drive be approved subject to obtaining the appropriate Minor Variance or
Zone Change, as outlined in Finance and Corporate Services Department report FCS-
17-148
10. INS-17-062 - DOON MILLS DRIVE TRAFFIC CALMING REVIEW
The Committee considered Infrastructure Services Department report INS-17-062, dated
August 15, 2017 recommending the installation of an intersection narrowing, chicane, a raised
narrowing, and road narrowing on Doon Mills Drive, and proposed parking prohibition in these
areas.
On motion by Councillor Z. Janecki -
it was resolved:
That an intersection narrowing be installed on Doon Mills Drive at Waterford Court, as
outlined in Infrastructure Services Department report INS-17-062; and,
That a chicane be installed on Doon Mills Drive 20 metres east of Pine Valley Drive;
and,
That a raised narrowing be installed on Doon Mills Drive approximately 150 metres east
of Pine Valley Drive at the trail crossing; and,
That a roadway narrowing be installed on Doon Mills Drive between Sugarmill Court
and Woodsmere Drive; and,
That parking be prohibited at any time in the immediate area of the chicane, narrowings,
and raised narrowing; and further,
That the Uniform Traffic By-Law be amended accordingly

11. INS-17-067 - WORK PERMIT BYLAW
The Committee considered Infrastructure Services Department report INS-17-067, dated
March 24, 2017 recommending approval of a Work Permit By-law, which will be incorporated
in the City of Kitchener Municipal Code as Chapter 890. Mr. K. Carmichael and Ms. S.
Brasseur were in attendance and responded to questions from the Committee.
On motion by Councillor S. Marsh -
it was resolved:
That user fees outlined within Infrastructure Services Department report INS-17-067 be
referred to the 2018 Operating Budget Process; and,
That the Municipal Code be updated to include a new Chapter 890 Work Permit bylaw
and that Council Policy #I-
repealed and replaced by Chapter 890 Work Permit bylaw; and,
That staff be directed to bring forward an amendment to Chapter 101 of the City of
Kitchener Municipal Code to facilitate enforcement of this proposed work permit bylaw;
and further,
That a 12 month temporary Traffic Project Coordinator position be referred to the 2018
Operating Budget
