The Heritage Kitchener Committee met this date, commencing at 4:04 p.m.

1. MIKE & PAT WAGNER HERITAGE AWARD INFORMATION
Mr. L. Bensason advised that at the March 2018 Committee meeting, the Committee
considered Community Services Department report CSD-18-046 regarding renaming the Mike
Wagner Heritage awards to the Mike & Pat Wagner Heritage Awards. He stated the award is
to honour people, property owners, businesses, organizations and institutions, who have
contributed to the conservation of our city's cultural heritage resources. He stated the award
was initially named after former Kitchener City Councillor Mike Wagner, who was a strong
advocate for heritage, culture and the arts. He indicated the award was recently renamed to
also recognize his wife Pat Wagner, a long-time member of the Heritage Kitchener Committee.
Mr. Bensason advised Pat Wagner has since passed away in May 2018 and requested the
Committee to extend their condolences to her family.
2. WELCOME - MS. ALISON BUCKING
Ms. M. Drake introduced and welcomed Ms. A. Bucking who recently joined the City as a
Student Planner. She indicated Ms. Bucking has expressed interest in Heritage Planning and
would be attending meetings in the future as part of her Co-op experience.
3. DSD-18-034 - HERITAGE PERMIT APPLICATION HPA-2018-IV-012
- 920 ORR COURT
- PROPOSED 2-STOREY FRONT PORCH AND REAR COVERED DECK
The Committee considered Development Services Department report DSD-18-034, dated May
11, 2018 recommending approval of Heritage Permit Application HPA-2018-IV-012 to permit
construction of a 2-storey front porch and rear covered deck on the property municipally
addressed as 920 Orr Court. Ms. A. Bucking presented the Report. Mr. D. Schooley was in
attendance to respond to questions from the Committee.
The following motion was voted on and Carried Unanimously.
On motion by Councillor P. Singh -
it was resolved:
That pursuant to Section 33 of the Ontario Heritage Act, Heritage Permit Application
HPA-2018-IV-012 be approved to permit the construction of a 2-storey front porch and
rear covered deck on the property municipally addressed as 920 Orr Court, in
accordance with the plans and supplementary information submitted with the
application, as outlined in Development Services Department report DSD-18-034 and
subject to the following condition:
a. That the final building permit drawings be reviewed and heritage clearance
provided by Heritage Planning staff prior to the issuance of a building permit.
4. HERITAGE PERMIT APPLICATION HPA-2018-IV-016
- 137-147 KING STREET EAST
- INSTALLATION OF NEW SIGN
The Committee considered an Internal Memo, dated May 23, 2018 recommending approval of
Heritage Permit Application HPA-2018-IV-016 to permit the installation of a new sign at the
property municipally addressed as 137-147 King Street East.

Ms. M. Drake provided an overview of the HPA, noting the property is designated under Part
IV of the Ontario Heritage Act. She indicated the applicant is proposing to install a new sign on
the existing building to facilitate a new use, which is anticipated to open in June 2018. She
presented the merits of the application, noting staff are recommending approval of the HPA
subject to the condition that the final sign permit drawings be reviewed and heritage clearance
provided by Heritage Planning staff prior to the issuance of a sign permit.
In response to questions, Mr. T. Bezner, Westmount Signs & Printing Co., advised that power
to the sign would be provided through surface mount conduits that will not penetrate the
building. He further advised there is no concrete block wall under the sign as noted in the
drawings circulated in the agenda package. He indicated he could update the drawings if
required.
The following motion was voted on and Carried Unanimously.
On motion by Councillor B. Ioannidis -
it was resolved:
That pursuant to Section 33 of the Ontario Heritage Act, Heritage Permit Application HPA-
2018-IV-016 be approved to the installation of a new fascia sign at the property municipally
addressed as 137-147 King Street East in accordance with the supporting information
submitted with the application and subject to the following condition:
a. That the final sign permit drawings be reviewed and heritage clearance
provided by Heritage Planning staff prior to the issuance of a sign permit.
5. DSD-18-038 - HERITAGE PERMIT APPLICATION HPA-2018-IV-011
- 48 ONTARIO STREET NORTH (FORMER LEGION BUILDING)
- REPAIR AND ALTERATION
The Committee considered Development Services Department report DSD-18-038, dated May
11, 2018 recommending approval of Heritage Permit Application HPA-2018-IV-011 to permit
repairs and alterations to the property municipally addressed as 48 Ontario Street North.
Mr. P. Ciuciura entered the meeting at this time.
Mr. L. Bensason presented the Report, advising staff are recommending approval of the
Heritage Permit Application (HPA) subject to conditions as outlined in the Report. He provided
an overview of the HPA, noting the property is currently owned by the City and has a
conditional approval of sale. He stated the applicant is required to obtain a building permit to
proceed with development of the property from the former Legion to an office use. He indicated
the applicant is proposing to repair, replace and alter certain heritage features, and requires
heritage approval prior to the issuance of the building permit. He provided an overview of the
merits of the application, stating staff are recommending approval of the HPA subject to
conditions as outlined within the Report.
In response to questions, Mr. F. Voisin advised
sensitive as they have a heritage mason scheduled to begin the work in July 2018.

That pursuant to Section 33 of the Ontario Heritage Act, Heritage Permit Application
HPA-2018-IV-011 be approved to permit the cleaning of existing masonry walls; repair
of existing masonry through repointing and selective brick replacement; repainting of
previously painted masonry; repair and replacement of existing brownstone features;
replacement of all existing windows and doors; introduction of five new window
openings; repair of the existing roof; replacement of the parapet flashing; and the repair
and restoration of the interior staircase and terrazzo floor, located on the property
municipally addressed as 48 Ontario Street North, as outlined in Development Services
Department report DSD-18-038, and in accordance with the supporting information
submitted with the application subject to the following conditions:
a. That a test panel be prepared to the satisfaction of Heritage Planning staff in
regard to the cleaning of the exterior masonry and the staining of the new
mortar before proceeding with said work.
b. That original brownstone features be cleaned and repaired as recommended
by a qualified mason having experience working with natural stone, and to the
satisfaction of Heritage Planning staff; and that in the event original
brownstone features are beyond reasonable repair as determined by the
mason and as confirmed by Heritage Planning staff, such features be
replaced with pre-cast concrete matching the form, design and colour of the
original brownstone features, to the satisfaction of Heritage Planning staff.
c. That the final building permit drawings be reviewed and heritage clearance
provided by Heritage Planning staff prior to the issuance of a building permit.
6. DSD-18-037 - HERITAGE PERMIT APPLICATION HPA-2018-IV-010

- DEMOLITION OF ADDITIONS, MASONRY REPAIR AND REINFORCEMENT,
AND RELOCATION OF FARMHOUSE TO FUTURE 68 SADDLEBROOK
COURT
The Committee considered Development Services Department report DSD-18-037, dated May
7, 2018 recommending approval of Heritage Permit Application HPA-2018-IV-010 to permit the
demolition of all additions, masonry repair and reinforcement to the farmhouse on the property
municipally addressed as 710 Huron Road, and relocation of the farmhouse to 68 Saddlebrook
Court.
Mr. L. Bensason presented the Report. He provided background information on the dwelling
currently located at 710 Huron Road, known as the Grant House, noting the Committee has
previously considered a Heritage Impact Assessment (HIA) and a Notice of Designation. He
stated the applicant now requires approval of an HPA to prepare the dwelling for relocation
and severing the original stone farmhouse from the existing additions. He indicated the house
needs to be relocated to a temporary location while grading in the subject area is being
completed by the developer. He stated once the grading is completed, the dwelling will be
moved to the lot where it is intended to be located within the subdivision. He provided an
overview of the merits of the application, noting staff are recommending approval of the HPA.
Mr. Bensason further advised it is anticipated that a separate heritage permit application will be
made following the relocation of the farmhouse, to address its rehabilitation and plans to
construct an addition and garage. Mr. Nick Bogaert, MHBC Planning was in attendance to
respond to questions from the Committee.
It was noted any recommendation arising from this matter would be considered at the June 25,
2018 Council meeting.

AND RELOCATION OF FARMHOUSE TO FUTURE 68 SADDLEBROOK

That pursuant to Sections 30(2), 33 and 34 of the Ontario Heritage Act, Heritage
Permit Application HPA-2018-IV-010 be approved to permit the demolition of all
th
additions on the 19 century stone farmhouse located on the property municipally
addressed as 710 Huron Road, known as the Grant House; the repair and
reinforcement of the original stone walls of the Grant House; and the relocation of the
original Grant House to the property to be municipally addressed as 68 Saddlebrook
Court, as outlined in Development Services Department report DSD-18-037, and in
accordance with the supporting information submitted with the application and subject
to the following conditions:
a. That the owner fulfill their obligations with regard to the relocation of the
Grant House, in accordance with the heritage covenant agreement registered
on title of 710 Huron Road; and,
b. That the final details of the method of moving the stone farmhouse be
reviewed and heritage clearance be provided by Heritage Planning staff prior
to the issuance of a building permit.
7. HERITAGE IMPACT ASSESSMENT (HIA) 10 DUKE STREET WEST
The Committee considered a Heritage Impact Assessment (HIA) prepared for 10 Duke Street
West. It was noted staff have requested an HIA in support of a Planning application where the
applicant intends to submit a Committee of Adjustment application to create a new lot from the
east side of the subject property. It was noted Heritage Planning staff are seeking the
review prior to recommending whether the Director of Planning will accept it.
Mr. D. Hauser, mcCallum Sather Architects, presented the HIA, including methodology that
was used, the historical significance of the property, and an overview of the current physical
design of the building. He provided information of the proposed redevelopment, including
potential heritage impacts the proposed addition may have on the existing structure. Mr.
Hauser noted the proposed development is intended to expand the existing commercial use of
the property by adding two floors, and a penthouse atop the 5th floor. He advised the intention
is to retain the existing building at the corner of Duke Street West and Queen Street including
all of the character-defining features described in the 'Statement of Significance'. He further
advised the future use of the building is proposed to be a commercial condominium.
In response to questions, Mr. Hauser advised although the property owner is proposing an
addition to the dwelling, the goal is to provide a clear distinction between the heritage portion
of the building and the addition. He stated the final design features are still to be determined.
He indicated consideration has been given to separating the existing portion of the building
with some type of architectural banding. Questions were raised regarding the proposed height.
Mr. Hauser stated in his opinion, although the addition would double the height of the existing
structure, it is believed to be complementary and uses the same rhythm of the existing heritage
development.
Mr. L. Bensason noted the comments regarding the proposed banding between the heritage
see a step-back or clearly
defined visual change between the existing heritage structure and the proposed addition. In
response, Mr. Hauser stated he was in agreement with staff preference, noting the final details
are still to be determined.
Questions were raised regarding interior changes and whether any significant modifications
were required to achieve the increase in height. Mr. Hauser advised there would be structural
modifications to accommodate the addition, as well as potential accessibility updates.

7. HERITAGE IMPACT ASSESSMENT (HIA) 10 DUKE STREET WEST
Mr. Bensason requested clarification on the proposed use of the subject property, questioning
if the building was being considered for a commercial condominium, has any consideration
been given to signage, as likely there will be multiple tenants occupying the space. Mr. Hauser
stated signage has not yet been considered. He stated that is a valid question and noted it for
further consideration.
Mr. S. Thomson and Mr. S. Miladinovic stated in their opinion, they would have preferred to
see any development to the structure be located at the rear of the property rather than adding
additional stories.
Ms. A. Reid stated she had no objections to an increase in the height of the existing building.
She indicated in her opinion, it is important to integrate and showcase the existing building in
the proposed development.
Questions were raised regarding the penthouse. Mr. J. Bedard, ABA Architects Inc., advised
half of the penthouse addition was intended for an interior mechanical room with various
metres for the individual units. He further advised there would be no additional requirements
for exterior mechanical units.
Councillors P. Singh and B. Ioannidis left the meeting at this time.
8. DSD-18-041 - HERITAGE PERMIT APPLICATION HPA-2018-V-015
- 17 DILL STREET
- PROPOSED 2-STOREY FRONT VERANDAH
The Committee considered Development Services Department report DSD-18-041, dated May
17, 2018 recommending approval of Heritage Permit Application HPA-2018-V-015 to permit
construction of a 2-storey verandah at the property municipally addressed as 17 Dill Street.
Ms. M. Drake advised, although the applicant was not in attendance this date, the application
was received in May 2018 and under the Act needs to be considered within 90 days. She
presented the Report, providing an overview of the merits of the application. She stated staff
are recommending approval with a condition requiring a heritage review of the building permit
prior to the building permit being issued.
In response to questions, the District was established in 1996. Ms. Drake advised she could
not confirm when the upper porch was removed. In response to further questions, she advised
when creating the Heritage Property Standards By-law, staff reviewed the properties within the
Heritage districts to identify properties of greater Heritage significance and identified them as
Group A properties. She commented that list has been approved by Council. She stated this
property was not identified as a Group A property on that list.

HPA-2018-V-015 be approved to permit the construction of a 2-storey verandah at the
property municipally addressed as 17 Dill Street, as outlined in Development Services
Department report DSD-18-041, and in accordance with the plans and supplementary
information submitted with the application and subject to the following conditions:
a. That the final building permit drawings be reviewed and heritage clearance
provided by Heritage Planning staff prior to the issuance of a building permit.

Mr. S. Burrows stated in regard to Best Practices review, consideration may need to be given
to a recourse mechanism for those heritage property owners that complete work without all the

required approvals. In response, Mr. Bensason advised every municipality handles these
situations differently. He indicated staff have undertaken a cursory review and in some
situations, municipalities have opted to impose fees on Heritage Permit Applications to those
people who do work without the required approvals. He stated it is something staff endeavour
to review and would likely bring forward a discussion paper to receive Committee feedback.
