Saunderson, Committee Administrator 1.CSD-19-011-NOISE EXEMPTION -DOWNTOWN SPECIAL EVENTS The Committee considered CommunityServices DepartmentreportCSD-19-011dated April 9, 2019 recommending approval of various noise exemptionsfor the Downtown Special Events. It was noted any recommendation arising from this matter would be considered at a special Council meeting later this date. On motion by CouncillorB. Ioannidis- it was resolved: “That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted for the Downtown Special Events, as outlinedin‘Schedule A’ to Community Services Department report CSD-19-011.” 2.CSD-19-012-NOISE EXEMPTION -GREEK FOOD FESTIVAL -527 BRIDGEPORT ROAD -JUNE 8-9, 2019 The Committee considered CommunityServices Department report CSD-19-012dated April 9, 2019recommending approval of a noise exemption for the Annual Greek Food Festival being held at 527 Bridgeport Road on June 8, 2019 from 12 noonto 11:00 p.m. and June 9, 2019from 12noon to 10:00 p.m. On motion by Councillor B. Ioannidis- it was resolved: “That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to the Greek Orthodox Community of Saints Peter and Paul Kitchener-Waterloo & th District for their Annual Greek Food Festival at 527 Bridgeport Road, to be held on June 8, th 2019 from 12:00p.m. to11:00p.m. and June 9, 2019 from 12:00p.m. to 10:00p.m., as outlined in Community Services Department report CSD-19-012.” 3.CSD-19-013-NOISE EXEMPTION -BARRA CONDOS -CONCRETE POURS -399QUEEN STREET SOUTH AND 168-180 BENTON STREET -MAY 2019 -SEPTEMBER 2019 The Committee considered CommunityServices Department report CSD-19-013dated April 23, 2019 recommendingapproval of a noise exemption to Polocorp Inc. for concrete pours at 399 Queen Street South and 168-180 Benton Streeton various datesfrom May to September 2019 between the hours of 7:00 p.m. and7:00 a.m. COMMUNITY & INFRASTRUCTURE SERVICES COMMITTEE MINUTES MAY 13, 2019-18-CITY OF KITCHENER 3.CSD-19-013-NOISE EXEMPTION -BARRA CONDOS -CONCRETE POURS -399 QUEEN STREET SOUTH AND 168-180 BENTON STREET -MAY 2019 -SEPTEMBER 2019 (CONT’D) On motion by Councillor B. Ioannidis- it was resolved: “That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to Polocorp Inc. for the development of the Barra Condos at 399 Queen Street South and 168-180 Benton Street, on various dates from May 2019 through September 2019 between the hours of 7:00 p.m. and 7:00 a.m., as outlined in Community Services Department report CSD-19-013.” 4.CSD-19-010-ADMINISTRATIVE MONETARY PENALTY SYSTEM (AMPS) -POLICIES The Committee considered CommunityServices Department report CSD-19-010dated April 23, 2019 recommending approval of the Administrative Monetary Penalty System (AMPS) policies as outlined in the Report. On motion by Councillor B. Ioannidis- it was resolved: “That Council approve the attached policies which support the implementation of the Administrative Monetary Penalty System (AMPS) as set out in Community Services Department report CSD-19-010; A.Policy to Prevent Political Interference B.Conflict of Interest and Code of Conduct Policy C.Policy Regarding Financial Management and Reporting D.Public Complaints Policy E.Undue Hardship Policy F.Policy for the Appointment of Screening and Hearing Officers” 5.DSD-19-093-NAMING OF A PRIVATE STREET –155 WESTWOOD DRIVE, COOK HOMES The Committee consideredDevelopmentServices Department report DSD-19-093dated April 15, 2019regarding the proposed naming of a private street ‘Gleason Crescent’ by Cook Homes within a vacant land condominium development located at 155 Westwood Drive. On motion by Councillor B. Ioannidis- it was resolved: “That the City of Kitchener acknowledge that Cook Homes proposes to name a private street ‘Gleason Crescent’ within a vacant land condominium development located at 155 Westwood Drive, as outlined in Development Services Department report DSD-19-093; and further, That the City’s Legal Services be directed to proceed with the required advertising, preparation and registration of the necessary By-law for the naming of the ‘Gleason Crescent’.” 6.DSD-19-103-ALL-WAY STOP CONTROL –GLEN ROAD & PLEASANT AVENUE The Committee considered DevelopmentServices Department report DSD-19-103 datedApril 17, 2019 recommending approvalof an all-way stop control at the intersection of Glen Road and Pleasant Avenue. On motion by Councillor B. Ioannidis- it was resolved: “That the Uniform Traffic By-law be amended for the installation of an all-way stop control at the intersection of Glen Road and Pleasant Avenue, as outlined in Development Services Department report DSD-19-103.” COMMUNITY & INFRASTRUCTURE SERVICES COMMITTEE MINUTES MAY 13, 2019-19-CITY OF KITCHENER 7.DSD-19-104-ALL-WAY STOP CONTROL –RITTENHOUSE ROAD & ERINBROOK DRIVE/MCCABE COURT The Committee considered DevelopmentServices Department report DSD-19-104dated April 17, 2019recommending approval of an all-way stop control at the intersection of Rittenhouse Road and Erinbrook Drive/McCabe Court. On motion by Councillor B. Ioannidis- it was resolved: “That the Uniform Traffic By-law be amended for the installation of an all-way stop control at the intersection of Rittenhouse Road and Erinbrook Drive / McCabe Court, as outlined in Development Services Department report DSD-19-104.” 8.INS-19-006-SAFETY AND LOSS MANAGEMENT SYSTEM AND GAS DISTRIBUTION SYSTEM INTEGRITY MANAGEMENT PROGRAM The Committee consideredInfrastructure Services Department report INS-19-006dated March 18, 2019recommendingapprovalof the Kitchener Utilities Natural Gas Distribution Policy, and the Gas Distribution System Integrity Management Program outlinepresented for information. On motion by Councillor B. Ioannidis- it was resolved: “That the Kitchener Utilities Natural Gas Distribution Policy be approved and that the Gas Distribution System Integrity Management Program outline, be presented for information in accordance with the Technical Standards and Safety Act, 2000 and Regulation 210/01: Oil and Gas Pipeline Systems,as outlined in Infrastructure Services Department report INS- 19-006.” 9.INS-19-007-DRINKING WATER QUALITY MANAGEMENT STANDARD (DWQMS) RE- ENDORSEMENT OF THE OPERATIONAL PLAN The Committee considered InfrastructureServices Department report INS-19-007dated March 7, 2019regardingthe re-endorsement of the Drinking Water Quality Management Standard (DWQMS) OperationalPlan. On motion by Councillor B. Ioannidis- it was resolved: “That the Drinking Water Quality Management Standards (DWQMS)Operational Plan attached toInfrastructure Services Department report INS-19-007, be re-endorsed in accordance with the Safe Drinking Water Act, 2002 and Regulation 188/07.” 10.INS-19-011-SURVIVOR GARDEN The Committee considered InfrastructureServices Department report INS-19-011dated April 24, 2019 regardingthe development of a Survivor Garden concept for Victoria Parkwith Scott Barker and Gateman MilloyInc. Mr. S. Barker presented the report, advising as a cancer survivor,it is his wish tohave a survivor garden installed in Victoria Park. Mr. M. Milloy stated Gateman MilloyInc.would like to collaboratewith City staff to donate the design and construction of a Survivor Garden within Victoria Park. He further advised,if approved,they are hoping to construct the garden in Spring 2020. The following motion was voted on and was Carried unanimouslyon a recorded vote. On motion by Councillor B. Ioannidis- it was resolved: COMMUNITY & INFRASTRUCTURE SERVICES COMMITTEE MINUTES MAY 13, 2019-20-CITY OF KITCHENER 10.INS-19-011-SURVIVOR GARDEN (CONT’D) “That staff be directed to work with Scott Barker and Gateman Milloy to develop a Survivor Garden concept for Victoria Park, as outlined in Infrastructure Services Department report INS-19-011; and, That staff be directed to undertake stakeholder engagement to inform the garden design; and, That the General Manager, Infrastructure Services be authorized to enter into the necessary agreements with Scott Barker and/or Gateman Milloy, and any other partner for the creation of a Survivor Garden, subject to the satisfaction of the City Solicitor; and further, That the Survivor Garden be included on the list of assets not to be sold for naming rights.” 11.INFORMATION ITEM -CSD-19-014-WILDFLOWERSNEIGHBOURHOOD ACTION PLAN The Committee considered Community Services Department report CSD-19-014 dated April 24, 2019 regarding the WildflowersNeighbourhood Action Plan (WNAP). Ms. S. Anderson provided opening remarks and introduced Mr. R. Chen, WildflowersAction Group (WAG). Mr. Chen presented the WNAP. Members of Council participated in a virtual reality session to view a documentary that promoted their neighbourhood stories and highlightedthe WNAP. 12.INS-19-009-WINTER SIDEWALK MAINTENANCE REVIEW The Committee considered InfrastructureServices Department report INS-19-009dated May 2, 2019 recommending approvalof the proposed winter sidewalk maintenance program for the 2019/2020 winter season.Ms. F. Hosseinipresented the Report. Mr. N. Lobley was in attendance to respond to questions from the Committee. Mr. D. Brotherson addressed Council in support of the City undertaking sidewalk winter maintenance. He stated in his opinion, the snow and ice By-law is ineffective and enforcement is not timely. Mayor B. Vrbanovic left the meeting at this time. A motion was brought forward by Councillor M. Johnston to approve the recommendation as outlined inreportINS-19-009. Councillor S. Marsh brought forward anamendment to Councillor Johnston’s motion to increase the capacity to the assisted services for sidewalk and windrow clearing as outlined in program component 5 from $25,000. as outlined in the Report to $75,000., to possibly provide a 100 residents access to the assisted services in 2019/2020. A motion was brought forward by Councillor S. Davey to defer program component 2 until May 2020, to allow staff an opportunity to conduct a statisticallyvalid survey. Councillor Marsh’s amendment was then votedonand was Carriedon a recorded vote with Councillors J. Gazzola, P. Singh, S. Davey, B. Ioannidis, M. Johnston, D. Schnider, D. Chapman, S. Marsh and C. Michaud voting in favour; and, Councillor K. Galloway-Sealock voting in opposition. Mayor B. Vrbanovic was absent and accordingly did not vote. Councillor S. Davey’s deferral motion was then voted on and was LOST on a recorded vote with Councillor S. Davey voting in favour; and, Councillors J. Gazzola, P. Singh, K. Galloway- Sealock, B. Ioannidis, M. Johnston, D. Schnider, D. Chapman, S. Marsh and C. Michaud voting in opposition. Mayor B. Vrbanovic was absent and accordingly did not vote. Councillor D. Chapman brought forward an amendment to Councillor Johnston’s motion to remove the 8cm threshold for program component 2 as outlined in the staff report, to direct staff to clear snow for all snow events. COMMUNITY & INFRASTRUCTURE SERVICES COMMITTEE MINUTES MAY 13, 2019-21-CITY OF KITCHENER 12.INS-19-009-WINTER SIDEWALK MAINTENANCE REVIEW (CONT’D) In response to questions, Ms. D. McGoldrick advised thatCouncillor Chapman’s proposed amendment for full snow clearing proposed in program component 2 would increase the budget by approximately $179,000. Additionally,she advised staff would not have any data to provide a recommendation on sidewalk winter maintenance related to major snow events. CouncillorChapman’s motion was then voted and LOST on a tie on a recorded vote with CouncillorsJ. Gazzola,D. Chapman,S. Marsh,C. Michaud and M. Johnstonvoting in favour; and, CouncillorsS. Davey, P. Singh, K. Galloway-Sealock, B. IoannidisandD. Schnidervoting in opposition. Mayor B. Vrbanovic was absent and accordingly did not vote. It was requested that program component 2 be voted on separately. The balance of the motion outlined in Report INS-19-009 as amendment was then voted on and was Carriedunanimouslyon a recorded vote. Mayor B. Vrbanovic was absent and accordingly did not vote. Program component 2 outlined in Report INS-19-009was then voted on and was Carriedon a recorded vote with Councillors J. Gazzola, P. Singh, K. Galloway-Sealock, B. Ioannidis, M. Johnston, D. Schnider, D. Chapman, S. Marsh and C. Michaudvoting in favour; and, Councillor S. Davey voting in opposition. Mayor B. Vrbanovic was absent and accordingly did not vote. On motion by CouncillorM. Johnston- it was resolved: “That staff be directed to conduct a review of the required level of service stated in By- law chapter 687 (Snow and Ice) as outlined in program component 1 of Infrastructure Services Department report INS-19-009, throughout summer 2019 and report back in fall 2019 with results and recommendations; and, That staff be directed to conduct a pilot to evaluate the initial clearing for 8cm snow events program as outlined in program component 2 of Report INS-19-009 throughout winter 2019/2020 and report back by May 2020 with results and recommendations; and, That staff be directed to develop priority route options as outlined in program component 3 of ReportINS-19-009 and report back by May 2020 with results and recommendations; and, That staff be directed to extend the proactive inspection pilot as outlined in program component 4 of Report INS-19-009 throughout winter 2019/2020 and report back by May 2020 with results and recommendations; and, That staff be directed to extend the assisted services for sidewalk and windrow clearing pilot outlined in program component 5, as amended, of Report INS-19-009 throughout winter 2019/2020 and report back by May 2020 with results and recommendations; and, That staff be directed to monitor and further evaluate the neighbourhood shared snow blower pilot as outlined in program component 6 of Report INS-19-009 throughout winter 2019/2020 and report back byMay 2020 with results and recommendations; and further, That staff be directed to conduct a representative valid survey as outlined in program component 7 of Report INS-19-009 and report back by May 2020 with results and recommendations.” 13.ADJOURNMENT On motion, this meeting adjourned at 1:53p.m. D.
