That the Mayor and Clerk be authorized to execute an Encroachment
Agreement, satisfactory to the City Solicitor, with the property owner of the
property municipally known as 87 King Street West to authorize the installation a
sign projecting out from the building façade which will encroach over the City’s
King Street road allowance.

That the CAO, Deputy CAO or Department Head be authorized to execute
routine applications, permits and other such documentation with the Regional
Municipality of Waterloo to facilitate the day to day business of the City of
Kitchener, provided however if such documentation requires a financial
commitment in excess of $50,000 or in excess of that which may have been
authorized in the budget, then Council approval of such expenditure is required
before said documentation is executed; said documentation to be to the
satisfaction of the City Solicitor.

That Michael Mooney be appointed as a Community Director to the Kitchener
Housing Incorporated Board of Directors for a term ending November 30, 2022;

That the City of Kitchener continue to provide an exemption from taxation for the

RECOMMENDATION:
“That the Mayor and Clerk be authorized to execute an Encroachment Agreement,

BACKGROUND:
The tenantat 87King Street West has asked for permission to install a sign projecting
out from the building façade that will encroach over the City’s King Street Westroad
allowance. The property owner will need to agree to enter into an encroachment
agreement to allow for this.
REPORT:
The tenantis asking for permission to installasign at the second storey level of the
property located at 87 King Street. This sign will project over the King Street sidewalk by
about .86 metres and will be about 4.87metres above ground.The signis notexpected
to interfere with pedestrian traffic.
The tenanthas submitted a sketchof the placement of the proposed sign. The sketch is
attached to this reportas Schedule “A”. This sketch has been circulated to city staff and
to externalutility companies for their comments.

Theproperty is listed on the Heritage Register due to the façades on the 2
and 3
storeys being one of the few remaining examples of ‘Berlin’ era main street architecture.
At the initial time of the application, two existing projecting signs have already been
erected at adjoining properties, and concernswere raised of a third sign causing
obstruction of the view of the architecture. However, one of the existing signs had neither
the correct permit nor an encroachment agreement in place; the applicant reached out to
the owner of the offending sign, and had them agree to take it down. As a result, City Staff
are now satisfied that the façade will not be majorly obscured if the applicant is allowed
to put up their own sign and are in support of the application.
Zayo Group also raised a concern about their infrastructure in that area, however it is
buried below ground and will not be impacted by the installation of the sign.
No other concerns were raised beyond the now-resolved heritageand utility issues.
ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN:
The recommendation outlined in this report supports the achievement of the City’s
strategic vision through the delivery of core service.
FINANCIAL IMPLICATIONS:
All fees associated with encroachments will be paid by the applicant. The Applicationfee
of $285.61has been paid. A processing fee of $240plus disbursementswill become
payable ifCouncil approvalis granted.

RECOMMENDATION:

BACKGROUND:
Citystaff deal with the Regional Municipality of Waterloo as part of the day to day operation of
the Cityfor which routine applications, permits, and other such documentation need to be
executed. Currently City being asked to execute a confirmation of compliance pertaining to the
stormwater discharge from the Battler Road Snow Storage and Disposal Facility. This isroutine
in nature and facilitates day to day business of the City.
REPORT:
Delegated authority to the CAO, Deputy CAO or the Department Heads (currently known as
General Managers but in the event those titles changeusing a generic reference) would facilitate
the City’s business in a timely manner. More and more of the documentation is requiring
execution by authorized signing representatives and in some cases, proof of such authority is
required. This resolution would clearly establish the authorized signing representativesfor
documentation required for the day to day business between the City and the Region.

BACKGROUND:
After every municipal election, appointments to advisory and quasi-judicial committees take place at the
Striking Committee meeting based on the recommendations of the Nominating Committee (the
Committee).After the November 19,2018 Striking Committee, thereremained some sector-specific
vacancies on some advisory committeesand Boardswhich were listed on the City’s website. Thewebsite
is updated on a continual basis as positions have been filled. The 2019 fall recruitment focused on the
following:
Remaining vacancies on advisory committees and Centre in the Square (CITS)from the 2018 fall
recruitment;

Board positions forCITS and Kitchener Housing Inc. (KHI) resulting from the expirations of terms
for some of their members; and,
Mid-term vacancies that have occurred for the Arts and Culture Advisory Committee as well as
the Cycling and Trails Advisory Committee.
Advertising took place for the vacancies remaining from the 2018 recruitment as well as upcoming
vacancies for Board positions. For the mid-term vacancies, staff reached out to applicants who had
previously applied but who had not been appointed. Staff determinedthe eligibility of all applicants and
oncetheir eligibility wasconfirmed, their name was put forward for consideration. If there were more
applications than vacancies, the applications were forwarded to the Nominating Committee to make a
recommendation for Council’sdecision. If there were not, the Director of Legislated Services/City Clerk
hasmade a recommendation directly to Council.
REPORT:
Arts and CultureAdvisory Committee(ACAC)
ACAC has had several resignations from the committee during 2019 resulting in three (3)vacant positions
(Citizen-at-Large, Practising Artist, and Arts Organization representative). Staff received two (2)
applications for the Citizen-at-Large vacancyandone (1) application for the Practising Artist vacancy.
No applications were received for the Arts Organization representative.The applications for the Citizen-
at-Large vacancy went to theNominating Committee who recommended Anabelle Girard. Because only
one application was received for the Practising Artist vacancy, Mark Waddell’s name is being presented
directly to Council for consideration.
Cycling and TrailsAdvisory Committee (CTAC)
As with ACAC, CTAC has two (2) Citizen-at-Large vacancies resulting from resignations. Staff received
five (5) applications, which were forwarded to the Nominating Committee. The Nominating Committee
has recommended Kyle Wagler and Geoff Kirk for Council’s consideration.
Heritage Kitchener
In response to the sector-specific vacancies listed on the City’s website, the City receivedone(1)
applicationfor Civic Centre Heritage Conservation Districtvacancyon Heritage Kitcheneras well as the
Archeology representative. Because there was only 1 applicationfor each vacancy,Becky Mueller and
Victoria Mance, respectively, arebeing recommended directly for Council’sconsideration.
Kitchener Housing Inc.
As per the October 23, 2019correspondenceto Councilfrom Ted Bleaney, Chair of the Board of Directors
for Kitchener Housing Incorporated (KHI), attached as Appendix ‘A’, the KHI Board is recommending the
appointments ofMichael Mooney as a Community Director and Mary Henein Thorn as an Associate
Director.
All candidates beingrecommendedto Councilfor advisory committeesare listed in Appendix ‘B’ while
unassigned applicants are listed in Appendix ‘C’.

RECOMMENDATION:
That the City of Kitchenercontinue to provide an exemption from taxationfor the
property leased by the Army, Navy and Air ForceVeteransClubfor a ten-year period
ending December 31, 2029.
REPORT:
Pursuant tosection 6.1 ofthe Assessment Act, Council may pass by-laws for exempting from
taxation, except for local improvement and school taxes, any land used or occupied as a
memorial home, clubhouse or athletic grounds by persons who served in the armed forces of
His or Her Majesty or an ally of His or Her Majesty in any war.
For a number of years, the City of Kitchener has passed a by-law granting exemptionsfor
Legions and Veterans’ Service Clubs. Under subsection 6.1(3) ofthe Assessment Act, these
exemptions may only be granted for a maximum period of ten years. The existing by-law expires
December 31, 2019.
On December 3, 2018, Bill 57, Restoring Trust, Transparency and Accountability Act, 2018
received Royal Assent. Included in Bill 57, was a change in the Assessment Actwhereby Royal
Canadian Legion memorial homes, clubhouses and athletic grounds are now exempt from
property taxation. However, property occupied by the Army, Navy and Air Force VeteransClub
was excluded from this exemption.
Staff are requesting that Council pass another by-law exempting the land occupied by the Army,
Navy and Air Force Veterans Club fromCity taxation for a ten-year period ending December 31,
2029. It is expected that the Region of Waterloo will provide a similar exemption for the Region’s
portion of the property taxes. Further, other area municipalities will also be passing by-laws
granting similarexemptions.

(Being a by-law to exemptthe Army, Navy and AirForce

WHEAREAS pursuant to the Assessment Act, Section 6.1 Kitchener City
Council may pass by-laws for exempting from taxation, except for local
improvement and school taxes, for a period not exceeding 10 years, any land used
or occupied as a memorial home, clubhouse or athletic grounds by persons who
served in the armed forces of His or Her Majesty or an ally of His or Her Majesty
in any war.
AND WHEREAS the membership of the Army, Navy and Air Force Veterans
Club are clubs specifically geared for persons who have served in the armed forces
of His or Her Majesty or an ally of His or Her Majesty in any war.
NOW, THEREFORE, COUNCIL OF THE CORPORATION OF THE CITY
OF KITCHENER ENACTS AS FOLLOWS:
1.Thatthe Army, Navy and Air Force Veterans Club are hereby exempt from the
city portion of municipal property tax, except for local improvements and school
taxes. This applies to any land used and occupied as a memorial home,
clubhouse or athletic grounds by persons who served in the armed forces of
His or Her Majesty or an ally of His or Her Majesty in any war.
2.T
his by-law shall take effect on January 1, 2020 and remain in effect for 10
years as long as the land is occupied and used for the purposes of the Army,
Navy and Air Force Veterans Club.
3.This by-law may be renewed at any time during the last year of the
exemption.

BACKGROUND:
In accordance with the Purchasing By-law 2017-106 (Chapter 170 Municipal Code), section
170.7.4 “the City's Director of Supply Services shall prepare a quarterly information only report
to Council on Solicitations awarded where the Procurement Value is between $100,000 and
$750,000 and the Director of Supply Services approved the award.” All recommendations
awarded by the Director of Supply Services were within approved budgets, capital projects were
specifically identified within the Council approved budget, there aren’t other orders of
government or granting agencies which require Council approval, and more than one bid was
received in response to the bid solicitation.

1.That, subject to the 2020 budget deliberations, $31,370.be allocated to Reep Green Solutions as
part of the Utilities 2020 Capital Budget, as outlined in Development Services Department report
DSD-19-246.
2.That the proposed fees and charges contained in the 2020User Fee Schedule attached to
Financial Services Department report FIN-19-077 be approved, as amended; and further,
ThatLegal Services staff be directed to prepare the necessary by-laws to amend The City of
Kitchener Municipal Code Chapters for fees and charges pertaining tolicensing, planning
applications, building permits and Committee of Adjustment applications.
COMMUNITY AND INFRASTRUCTURE SERVICES COMMITTEE –OCTOBER 21, 2019
1.That the Uniform Traffic By-Law be amended for the conversion of Bell Lane from two-way
operation to one-way westbound operation between Water Street North and a point approximately
20 metres east of Francis Street North, and that on-street parking be permittedon the North side
of the laneway, as outlined in Development Services Department report DSD-19-236.
2.That the City of Kitchener’s Complete Streets guidelines, attached as Appendix ‘A’ to Development
Services Department report DSD-19-235, be approved and applied to the design of future street
reconstruction projects;and,
That the Complete Streets scorecard, included in Appendix ‘A’, be incorporated into street
reconstruction project planning and reporting; and,
That staff be directed to update thecity’s Development Manual to incorporate the Complete Streets
vision, goals, principles and street designs into new developments; andfurther,
That staff be directed to report back to City Council on progress in 2024.
3.That staff be directed to bringforward a report to a future Community and Infrastructure Services
Committee meeting for consideration, related to what would be required to develop a plan to
become a Vision Zero community.
4.That Chapter 687(Snow and Ice)of the City of Kitchener’s Municipal Codebe repealed and
replacedwith a new Winter Maintenance By-law,as outlined in Community Services Department
report CSD-19-032.
5.That the pilot to allow parking on paved boulevards City-wide be made permanent and be permitted
annually from December 1 thru March 31,and that an additional guideline be added to the program
that requires any vehicle parked on a boulevard within a school zone from Monday to Friday to be
removed by 8:00a.m., as outlined in Community Services Department report CSD-19-031.
6.That a by-law to regulate traffic and parking on highways under the jurisdiction of the Corporation
of the City of Kitchener, be enacted, as outlined in Development Services Department report DSD-
19-160; and further,
That amendments to the Administrative Monetary Penalty System (AMPS) By-lawbe approvedto
incorporatethe new Uniform Traffic By-law.
