DSD-20-065 - ZONING BY-LAW AMENDMENT ZBA/20/002/E/KA <br /> - 83 ELMSDALE DRIVE <br /> - ARIA TOWNS INC. <br /> - REMOVAL OF HOLDING PROVISION <br /> <br /> The Committee considered Development Services Department report DSD-20-065, dated June <br />29, 2020, recommending approval of Zoning By-law Amendment Application ZBA/20/002/E/KA <br />(83 Elmsdale Drive) for Aria Towns Inc. <br /> <br />On motion by Councillor B. Ioannidis - <br />it was resolved: <br /> <br />That Zoning By-law Amendment Application ZBA20/002/E/KA (83 Elmsdale Drive) for <br />Aria Towns Inc., for the purpose of removing Holding Provision 71H from a portion of the <br />Proposed By- <br />dated June 30th, 2020, attached to the Development Services Department report DSD- <br />20-065 as Appendix A, be approved; and further, <br /> <br />That in accordance with Planning Act Section 45 (1.3 & 1.4) that applications for minor <br />variances shall be permitted for lands subject to Zoning By-law Amendment Application <br />ZBA20/002/E/KA. <br /> <br />Councillor S. Marsh advised this is a formal public meeting to consider applications under the Planning <br />Act. If a person or public body that would otherwise have an ability to appeal a decision of the City of <br />Kitchener to the Local Planning Appeal Tribunal, but the person or public body does not make oral <br />submissions at the public meeting or make written submissions to the City of Kitchener before the By- <br />law is passed, the person or public body is not entitled to appeal the decision. <br /> <br />2. DSD-20-001 - ZONING BY-LAW AMENDMENT APPLICATION ZBA20/001/D/GS <br /> - 206 & 210 DUKE STREET EAST <br /> - OWNER: THE TRUSTEES OF THE PILGRIM EVANGELICAL LUTHERAN <br />CHURCH & TRUSTEES FOR THE PILGRIM EVANGELICAL LUTHERAN <br />CHURCH <br /> - APPLICANT: MHBC PLANNING FOR VIVE DEVELOPMENT <br /> <br />The Committee considered Development Services Department report DSD-20-069, dated July 8, 2020, <br />recommending approval of Zoning By-law Amendment Application ZBA20/001/D/GS requesting a <br />change from Neighbourhood Institutional Zone (I-1) and Residential Seven (R-7) with Special <br />Regulation 755R and Special Use Provision 480U. In addition the Committee was in receipt of a written <br />submission received from Tony Hanusiak in opposition to the application. <br /> <br />Mr. G. Stevenson presented the report to Council and provided an overview of the application. <br />In response to Council's questions, Mr. Stevenson discussed the zone change in anticipation of <br />a future development application, considerations for affordable housing, and the possible future <br />implementation of inclusionary zoning. <br /> <br /> <br />
