DSD-20-103 - ZONING BY-LAW AMENDMENT Application ZBA/20/007/W/AP - 1333 WEBER STREET EAST, 1776411 ONTARIO LTD. - REMOVAL OF HOLDING PROVISION The Committee considered Development Services Department report DSD-20-103, dated August 18, 2020, recommending approval of Zoning By-law Amendment Application ZBA/20/007/W/KAP (1333 Weber Street East) for 1776411Ontario Ltd. On motion by Councillor B. Ioannidis - it was resolved: That Zoning By-law Amendment Application ZBA20/007/W/AP for 1333 Weber Street East for 1776411 Ontario Ltd. for the purpose of changing the zoning by removing Holding Provisions 76H, 77H, and 22HSR from the lands specified in the attached Map No.1, in the - Development Services Department Report DSD-20-103 as Appendix A, be approved. Councillor S. Marsh advised that the meeting was a formal public meeting to consider applications under the Planning Act. If a person or public body that would otherwise have an ability to appeal a decision of the City of Kitchener to the Local Planning Appeal Tribunal, but the person or public body did not make oral submissions at the public meeting or make written submissions to the City of Kitchener before the By-law is passed, the person or public body is not entitled to appeal the decision. 2. DSD-20-074 - ZONING BY-LAW AMENDMENT APPLICATION ZBA19/002/O/BB - GRAVEL RIDGE TRAIL, HURON CREEK DEVELOPMENTS - 25302229 ONTARIO INC. The Committee considered Development Services Department report DSD-20-074, dated July 13, 2020, recommending approval of Zoning By-law Amendment Application ZBA19/002/O/BB requesting a change from Agricultural Zone (A-1) to Residential Six Zone (R-6) with Site Specific Regulation Provision 754R and Open Space Two Zone (P-2); and, recommending that the Laurentian West Community Plan be amended. B. Bateman, Senior Planner, presented the report to Council and provided an overview of the application. In response to Council's questions, staff spoke to considerations for affordable housing, zoning, access points, and traffic conditions. Brandon Flewwelling, GSP Group, was in attendance in support of the staff recommendation. Ammori Ganem-Mohamed spoke in opposition, and Amit Tejpal also submitted his opposition in writing to the proposed development due to concerns regarding access to the local green space, density, and traffic. Ioannidis it was resolved: That Zoning By-law Amendment Application ZBA19/002/O/BB (Gravel Ridge Trail; 25302229 Ontario Inc.) for the purpose of changing the zoning from Agricultural Zone (A- 1) to Residential Six Zone (R-6) with Site Specific Regulation Provision 754R and Open Space Two Zone (P-2) on the lands specified on the attached Map No. 1 in the form -Development Services Department Report DSD-20-074 as Appendix A, be approved; and further, That the Laurentian West Community Plan be amended as follows: - designate the lands legally described as Part of Lots 130, German Company Tract, RP 58R--40 UPH) Phase 3 of the Community Plan; and, That the Urban Design Brief attached to Development Services Department Report DSD-20-074 as Appendix B, be adopted and provide the basis for future site development; and further, That in accordance with Planning Act Section 45 (1.3 & 1.4) that applications for minor variances shall be permitted for lands subject to Zoning By-law Amendment Application ZC19/002/O/BB. 3.
