Gosse, Director of Legislated Services/City Clerk PREPARED BY: Patricia Harris, Manager of Licensing WARD(S) INVOLVED: 3 DATE OF REPORT: March 31, 2010 REPORT NO.: CRPS-10-040 SUBJECT: REQUEST FOR OUTDOOR FOOD & MERCHANDISE VENDORS - DOON HERITAGE CROSSROADS - MAY 29, 2010 RECOMMENDATION: That the request of Doon Heritage Crossroads to invite 1 food vendor and approximately 5 merchandise vendors to operate at the Emergency Services Muster Games and Parade on May 29, 2010, at 10 Huron Road, be approved, providing the necessary licence, including Health and Fire approvals, are obtained; and further; That the reduced fee of $45.00 be applicable. BACKGROUND: Chapter 549 of the City of Kitchener Municipal Code states that a Temporary Retail Market Licence is required for a show with 5 or more vendors selling their own goods or services. The licence fee is $450.00. Chapter 501 (Business Licensing Fees) in Section 501.2.4 states that where an application is made for a licence by a recognized, registered bona fide charitable organization, the fee to be paid shall be 10% of the fee that would otherwise be payable. In cases of doubt, as to the application of this section, the Manager of Licensing shall refer the application to Council for a decision. In regards to this request, the “charitable” provision does not apply, as each merchandise vendor will keep the proceeds from any sales they make. Chapter 586 (Refreshment Vehicles) requires that no licence be issued for the sale of food on public property until Council permission is obtained. Council has approved this request for the past several years. REPORT: Correspondence has been received from Wendy Connell, Supervisor of Programs, Waterloo Region Museums requesting permission for one food vendor and approximately five th merchandise vendors to operate on May 29, 2010 during the 17 annual Emergency Services Muster, Games and Parade at Doon Heritage Crossroads. é ó ï Ms. Connell has advised that the proceeds from the sale of the food will be donated to the various programs that the Muster is supporting this year. The proceeds from the sale of the merchandise, emergency services memorabilia will be kept by each of the vendors. FINANCIAL IMPLICATIONS: Reduction in revenue is $405.00 .
