SUBJECT: LICENSING AGREEMENT, NEW PROVINCIAL
COURTHOUSE
RECOMMENDATION:
That the Director of Engineering be authorized to execute an agreement satisfactory to
the City Solicitor permitting the operation of crane(s) over City land in connection with
the construction of the Provincial Courthouse; and further,
That the Director of Engineering be authorized to execute future agreements satisfactory
to the City Solicitor permitting the installation or operation of crane(s) on or over City
land.
BACKGROUND:
The construction of the new Provincial Courthouse at the intersections of Weber St.IFrederick
St.l Duke St./Scott St. will require the use of a tower crane on the site. The swing boom of the
crane will be operated over City land adjacent to the site, specifically sections of Duke St. and
Scott St. An agreement is required for approval to operate over municipal property.
REPORT:
Construction of the Provincial Courthouse on the block bounded by Weber St.IFrederick
St.lDuke St./Scott St. requires the use of a construction tower crane on the site. The operation
of the crane will entail the hoisting/movement of the crane boom and construction
material/equipment above and over portions of Duke St. and Scott St. as illustrated on Appendix
"A" attached. Normal use of these roads by pedestrians and vehicles will not be affected by the
crane operation. Installation and operation of the crane is anticipated to commence in the later
part of May 2010. Approval for the encroachment over City land by the crane operation is to be
provided in the form of a licensing agreement between the City and the appropriate parties in
accordance with the terms set out to the satisfaction of the City Solicitor.
