The request for the noise by-law exemption is for between the hours of 7:00 p.m. and 7:00 a.m. for the period April 5, 2010 to November 1, 2010. BACKGROUND: The 2010 stage for the reconstruction of King Street (Contract T08-015) between Young Street and Francis Street will commence on or about April 5, 2010, weather permitting, and is anticipated to be completed by the end of September, 2010. This project includes the following planned work: Municipal services -miscellaneous storm sewer and fire hydrant relocation Underground utilities -underground electrical, gas and telecom services Street lights and special event power • Roadway surface, sidewalks and paving stones Curb and gutter, and, • Landscape construction. REPORT: In order to complete the work and minimize disruption for the King Street businesses and complete the necessary improvements, extended hours and weekend work must take place to complete the project within the established time allotment. This exemption is requested to complete certain operations of work to mitigate the impact of construction. 8-1 The present work that is proposed to date for after hours work includes, but is not limited to: Watermain servicing and hydrant relocation will be completed early in the project and will entail work after hours when businesses are closed, during the approximate times of 2:00 a.m. to 6:00 a.m. Prior to commencement, this work will be communicated by letter to all businesses and residents that will be directly affected. These times were chosen in order to minimize the impact on adjacent businesses and their operations. SCOPE /STAGING OF WORK: There are several stages to the King Street Streetscape (see copy attached). The staging of the work proposed for 2010 includes: Stage 4a: Young Street to College StreetlGaukel Street including Young St intersection Stage 4b: College Street to Water Street including the Water St intersection Stage 5: Water Street to Francis Street In general, the scope of this project includes the following planned work: • Fire hydrant relocation (typically between 2:00 a.m. to 6:00 a.m.) • Concrete sidewalk removal (typically between 4:00 a.m. to 7:00 a.m.) -this is specific to business access purposes only. • Paving stone installation (typically between 7:00 p.m. to 7:00 a.m.) and • Potential paving operations. TYPE OF NOISE: The majority of the noise will be created by the removal of concrete and services along with excavation of the sidewalk area in order to complete the work. During the road works, the use of a milling machine and paving equipment will be used to resurface King Street. This work will be undertaken during permitted working hours (7:00 a.m. to 7:00 p.m.). The road works will be completed at the end of the project, once the sidewalks are complete. There may be extended work hours implemented in order to accommodate an increased work schedule in each stage of the work. Concrete pours will be scheduled beyond regular working hours where necessary to address concerns for business access during business hours to entrances directly onto King Street. These additional hours of permitted work are requested to allow for the most impactful work operations to be conducted during the hours of 7:00 a.m. to 7:00 p.m., allowing for less impactful operations such as preparation work, forms preparation and removal and general site clean up to be completed outside of these hours. This less impactful work will not commence before 6:00 a.m. and is expected to go no later than 10:00 p.m. Noise protocol will be followed, which covers administrative measures such as scheduling of noisy activities at times of least impact, selection of haulage routes to minimize close proximity to neighbours, and maintaining contact with residents. Additionally, the City of Kitchener and their consultant have advised that any changes to the work schedule proposed by the contractor will be addressed on its own merits and that any additional noise impacts outside of the permitted hours will require further approval by the project team and as such, detailed communication will be provided to residents and businesses along King Street. 8-2 In order to expedite the construction and allow extended hours of work to take place for this project, thereby minimizing traffic impacts, we recommend that this request for a noise by-law exemption be granted. The extension of the working hours will accommodate intersection/ detour traffic and business needs. DURATION: Regular working hours will include and are permitted 7:00 a.m. to 7:00 p.m. Monday to Saturday; however the Contractor is requesting to work extended hours when required to complete work sensitive to traffic issues and to benefit the project timelines. Regular extended hours will include 7:00 p.m. to 7:00 a.m. Monday to Saturday in order to reduce impacts of business operations. Sunday work may occur between 8:00 a.m. to 5:00 p.m. and would be limited to general clean up and preparation work where formal inspection would not be necessary. Sunday work is a possibility for paving, but inspection would be required for this operation. All additional work will be assessed by City staff for allowing extended hours and will be defined as a benefit to the project. Council will be notified at least a minimum of 48 hours in advance of the work as the need arises. FINANCIAL IMPLICATIONS: None. Provisions have been included in the contract, encouraging the contractor to complete this work as soon as reasonably possible. COMMUNICATIONS: The City of Kitchener and its contractor will communicate the expectation of extended working hours to area residents I businesses and have been actively advising of any changes as they develop. Communication updates will be provided on a regular basis. CONCLUSION: In order to expedite the construction and allow extended hours of work to take place for this project, thereby minimizing-disruption and impacts of construction on businesses l residents, we recommend that this request for a noise by-law exemption be granted.
