Subject: PARK STREET RECONSTRUCTION -UNION BOULEVARD
TO GREEN STREET- NOISE EXEMPTION
RECOMMENDATION:
That City of Kitchener and its contractor(s) be exempt from the provisions of Chapter 450
Noise of the City of Kitchener Municipal Code Article 6 Construction Work during the
Park Street Reconstruction project in the City of Kitchener. The request for the noise by-
law exemption is for the hours between 7:00 p.m. and 7:00 a.m. for the period April 6,
2010 to J u ly 13, 2010.
BACKGROUND:
The City of Kitchener's Contract No. T10-017 will see the reconstruction of Park Street from
west of Stewart Street to the west City limit. The project has been scheduled for construction in
the years 2010 and 2011.
Stage 1 -Park Street from east of Union Boulevard intersection to west of Wood St
Stage 1 a -Gildner Street from the Iron Horse Trail to York Street
Stage 1 b -Gildner Street from York Street to Park Street
Stage 2 -Park Street from west of Wood Street to Green Street
Stage 3 -Wood Street from Eden Street to Park Street
Stage 4a -Park Street from Dominion Street to south of GEXR rail tracks
Stage 4b -Park Street from Strange Street to Dominion Street
Stage 4c -Park Street east of Union Boulevard to City boundary
These stages of work include:
• Road and reconstruction of underground services
• Paving -base course asphalt
Watermain tie-ins
Sidewalk, curb and gutter installations.
It is for stages 1 and 2 (Park Street -Union Boulevard to Green Street) that the noise
exemption is requested.

REPORT:
In order to complete the work and minimize disruption for the Park Street businesses and the
Grand River Hospital and complete the necessary improvements, extended hours and weekend
work must take place to complete the project in the time allotment. This exemption is requested
to complete certain operations of work to mitigate the impact of construction.
The following work is proposed to take place outside the typical 7:00 a.m. to 7:00 p.m. permitted
construction period:
• Due to the need for water services for businesses during daytime business hours,
watermain servicing and hydrant relocation will be completed during the approximate
times of 2:00 a.m. to 6:00 a.m.
• Due to the Grand River Hospitals need to maintain access to their loading facilities
during peak weekday periods, work on Saturday lSunday will be required for two
weekends in May and one weekend in July.
• Prior to commencement, this work will be communicated by letter to all businesses and
residents that will be directly affected. These times were chosen in order to minimize the
impact on adjacent businesses and their operations.
SCOPE 1 STAGING OF WORK:
Noise Impact Details
Access to loading docks for GRH
• Two (2) weekends in May
• Sanitary sewer and watermain removal and replacement.
• Equipment such as excavators, dozers, dump truck, front end loader all which are
equipped with backup beepers. There will also be generators, pumps, quick-cuts,
jumping jack, and a pad foot roller will be used.
Concrete work (i.e. curb, gutter and sidewalk installation
• Two (2) weekends in June
• Curb machines, rubber tire backhoes, concrete trucks, dump trucks and a smooth
drum roller will be used.
Paving -base course asphalt
• One (1) weekend in July
• Paving crew (spreader, rubber tire roller, smooth drum roller and dump trucks).
To complete final watermain tie-ins
• Excavators, dozers, dump truck, front end loader all which are equipped with backup
beepers will be used. There will also be generators, pumps, quick-cuts, jumping
jack, and a pad foot roller.
• Work will be completed on an as required basis for water sensitive businesses (i.e.
GRH, dentists, and doctor's offices).
There will be additional work during off hours and will be on a required basis only.

TYPE OF NOISE:
The majority of the noise will be created by the removal of concrete and services along with
excavation of the sidewalk area in order to complete the work. During the road works, the use
of a milling machine and paving equipment will be used to resurface Park Street. This work will
be undertaken during permitted working hours (7:00 a.m. to 7:00 p.m.). The road works will be
completed at the end of the project, once the sidewalks are complete. There may be extended
work hours implemented in order to accommodate an increased work schedule in each stage of
the work. Concrete pours will be scheduled beyond regular working hours where necessary to
address concerns for business access during business hours to entrances directly onto Park
Street.
Noise protocol will be followed, when possible, which covers administrative measures such as
scheduling of noisy activities at times of least impact, selection of haulage routes to minimize
close proximity to neighbours, and maintaining contact with residents.
In order to expedite the construction and allow extended hours of work to take place for this
project, thereby minimizing traffic impacts, we recommend that this request for a noise by-law
exemption be granted.
DURATION:
Regular working hours will include and are permitted 7:00 a.m. to 7:00 p.m. Monday to Friday.
Regular extended hours will include 7:00 p.m. to 7:00 a.m. Monday to Saturday in order to
reduce impacts of business operations.
All additional work will be assessed by City staff for allowing extended hours and will be defined
as a benefit to the project. Council will be notified at least a minimum of 48 hours in advance of
the work as the need arises.
FINANCIAL IMPLICATIONS:
None. Provisions have been included in the contract, encouraging the contractor to complete
this work as soon as reasonably possible.
COMMUNICATIONS:
The City of Kitchener and its contractor will communicate the expectation of extended working
hours to area residents /businesses and have been actively advising of any changes as they
develop. Communication updates will be provided on a regular basis.
CONCLUSION:
In order to expedite the construction and allow extended hours of work to take place for this
project, thereby minimizing-disruption and impacts of construction on businesses /residents, we
recommend that this request for a noise by-law exemption be granted.
