APRIL 28, 2003 CITY OF KITCHENER
A special meeting of City Council was held at 12:10 p.m. this date, Chaired by Mayor C. 7ehr with all
members present except Councillors G. Lorentz, J. Smola and J. Gazzola.
Notice of this special meeting had been previously given to all members of Council by the City Clerk
pursuant to Chapter 25 (Council Procedure) of the Municipal Code.
Council was in receipt of Tender T03-001, dated April 24, 2003, recommending that concrete
sidewalk and curb construction and repairs be awarded to 1123491 Ontario Inc. Councillor C. Weylie
requested a list of the sidewalk and curb construction and repairs. Mr. L. Lynch, Manager of
Engineering Rehabilitation informed Council that a list of the 2003 sidewalk construction and repairs
is posted on the Internet but he would provide Council with the requested information.
Moved by Councillor M. Galloway
Seconded by Councillor C. Weylie
"That Tender T03-001, Concrete Sidewalk & Curb Construction and Repairs, be awarded to
1123491 Ontario Inc. (cia United Contracting [London]), London, Ontario, at a reduced
tendered price of $1,085,222.36, including contingencies of $40,812.50 and G.S.T.; and further,
That the Mayor and Clerk be authorized to execute an agreement satisfactory to the City
Solicitor."
Carried.
Council was in receipt of a letter dated April 23, 2003 from G. Sosnoski, General Manager of Corporate
Services & City Clerk, recommending that the applications relative to cancellation, reduction, refund or
levy of taxes be disposed of as recommended on the attached Council Tax Adjustment Report, dated
April 23, 2003.

"That the applications attached hereto and forming part of these minutes relative to cancellation,
reduction, refund or levy of taxes be disposed of as recommended therein."
Carried.
Council considered a recommendation from staff to grant an Adult Entertainment Parlour Licence for 8-
404 Courtland Avenue East for an 8-month term, expiring December 31, 2003, and granting an Adult
Entertainment Parlour Licence for 2271 Kingsway Drive for a 2-month term expiring July 4, 2003.

"That Randy Zivkovic be granted a 2003 Adult Entertainment Parlour Licence for 8-404 Courtland
Avenue East, Kitchener, for an 8-month term from April 30 - December 31,2003; and further,
That Brad Baumbach be granted a 2003 Adult Entertainment Parlour Licence for 2271 Kingsway
Drive, Kitchener, for a 2-month term from April 30 - July 4, 2003."
Carried.
Mayor C. Zehr informed Council of an additional item for in-camera discussion this date involving a land
acquisition matter.

Seconded by Councillor M. Galloway
"That an in-camera meeting of City Council be held immediately following recess of this special
meeting to consider a labour relations matter, two matters subject to solicitor-client privilege
and a land acquisition matter."

SPECIAL COUNCIL MINUTES
APRIL 28, 2003 - 131 - CITY OF KITCHENER
The special Council meeting then recessed at 12:15 p.m. and re-convened at 3:07 p.m., Chaired by
Mayor C. 7ehr, with all members present except Councillor J. Gazzola.
Council considered a recommendation arising from the Finance and Corporate Services Committee
meeting held this date with respect to Corporate Services Department report CRPS-03-075 regarding
a request to operate two hot dog carts during the Annual Community Garage Sale on May 3, 2003.
Moved by Councillor B. Vrbanovic
Seconded by Councillor C. Weylie
"That the request of Les Halat to operate two hot dog carts, one at 273 Stoke Drive and one at
112 Wexford Crescent, during the annual Community Garage Sale on May 3, 2003, be
approved, provided the necessary licence, including Health and Fire approval, is obtained."

Council considered a matter arising from the in-camera meeting of Council held this date regarding a
Memorandum of Settlement between the City and I.B.E.W. Local 636 Gas & Water Utility Employees.
Moved by Councillor B. Vrbanovic
Seconded by Councillor J. Smola
"That the terms and conditions contained in the Memorandum of Settlement dated April 22, 2003
in connection with the 2003-2004 Collective Agreement with I.B.E.W. Local 636 Gas and Water
Utility employee be approved; and further,
That the Mayor and Clerk be authorized to execute any documentation arising therefrom."

Seconded by Councillor C. Weylie
Carried.
"That leave be given the Mover and Seconder to introduce a by-law to confirm all actions and
proceedings of the Council and that the same be taken as read a first, second and third times, be
finally passed and numbered 2003-70 by the Clerk."
Carried.
On motion, the meeting adjourned at 3:10 p.m.
