McColl OFFICIALS PRESENT: Ms. J. von Westerholt, Senior Planner, Mr. J. Lewis, Traffic Technologist, Ms. D. Gilchrist, Secretary-Treasurer and Ms. D. Saunderson, Administrative Clerk Mr. D. Cybalski, Chair, called this meeting to order at 10:00 a.m. This meeting of the Committee of Adjustment sitting as a Standing Committee of City Council was called to consider applications regarding variances to the City of Kitchener Sign By-law. The Committee will not make a decision on these applications but rather will make a recommendation which will be forwarded to the Committee of the Whole and Council for final decision. The Chair explained that the Committee's decisions with respect to sign variances are recommendations to City Council and not a final decision. He advised that the Committee's recommendations will be forwarded to City Council on Monday June 14, 2010 at 7:00 p.m., and the applicants may register with the City Clerk to appear at the meeting if desired. NEW BUSINESS 1. Submission No.: SG 2010-011 Applicant: Infrastructure Ontario Property Location: 59 Frederick Street Legal Description: Part Lot 1, Plan 364, Part Lots 5, 6 & 7, Plan 372 Appearances: In Support: J. Axisa Contra: None Written Submissions: None The Committee was advised that the applicant is requesting permission to erect banner signs on a construction site fence on Duke, Weber and Scott Streets, for a temporary period of time (until January 2013); whereas the Sign By-law does not permit signs to be located on fences. The Committee considered the report of the Development and Technical Services Department, dated March 2, 20010, advising that the subject property is located at 59 Frederick Street and is zoned Office District Zone (D-4) in the Zoning By-law with special provision 100R and 114. It is designated in the Official plan as Downtown Office Land Use District and Market Design District. The applicant is requesting a variance to locate ten banner material signs on a construction fence along Duke, Weber and Scott Street whereas Section 680.3.14 does not permit signs on fences. Signs are 0.9 m high by 3.22 m wide, except the "Gate" and "Authorization" signs at the gates which are 0.9 m high by 1.7 m wide. The intent of this section of the Sign By-law is to ensure that the signs will be aesthetically pleasing and will not negatively interfere with the streetscape. Staff is of the opinion that the variance is minor and enhances the usability, safety and functioning of the site during construction. "Ellis Don" signs note that this site in the correct location for the construction project. The Gate Area signs are used to direct deliveries to the right area on site. "Unauthorized access sign" are to ensure all deliveries are reported to the office. It is understood that the signs will be removed when landscaping for the new building is implemented before January 2013 upon completion of the construction on the subject property. Therefore, staff has no concerns with the requested variance. COMMITTEE OF ADJUSTMENT 18 MAY 18, 2010 Submission No.: SG 2010-011 (Cont'd The Committee considered the report of the Region of Waterloo Transportation Planner, dated February 4, 2010, advising that they have no objections to the sign application. They do note however, that a sketch in the application indicates a future gate to both Weber Street and Frederick Street. Staff have had discussions with Ellis Don and Infrastructure Ontario and indicated that the Region would not be in support of any access for construction or delivery vehicles to these roadways. All access during construction must be from Duke Street or Scott Street. The Chair noted the comments of the Region of Waterloo regarding future access gates. Ms. Axisa noted that she had spoken with the Region and the proposed access gates shown on the plan will not be used. Moved by Mr. M. Hiscott Seconded by Mr. B. McColl That the application of Infrastructure Ontario requesting permission to erect banner signs on a construction site fence on Duke, Weber and Scott Streets, for a temporary period of time; whereas the Sign By-law does not permit signs to be located on fences, on Part Lot 1, Plan 364, Part Lots 5, 6 & 7, Plan 372, 59 Frederick Street, Kitchener, Ontario, BE APPROVED, subject to the following condition: That the owner shall apply for and receive approval of a sign permit from the City of Kitchener. It is the opinion of this Committee that: The variance approved in this application is minor in nature. 2. This application is desirable for the appropriate development of the property. 3. The general intent and purpose of the Chapter 680 (SIGN) of the City of Kitchener Municipal Code is being maintained on the subject property.
