HomeMy WebLinkAboutCRPS-10-073 - Exemption to c450 Noise - Kitchener Portuguese ClubREPORT REPORT TO: Finance and Corporate Services Committee DATE OF MEETING: June 7, 2010 SUBMITTED BY: Troy Speck, General Manager of Corporate Services PREPARED BY: Shayne Turner, Director of By-law Enforcement WARD(S) INVOLVED: South DATE OF REPORT: May 14, 2010 REPORT NO.: CRPS-10-073 SUBJECT: EXEMPTION TO CHAPTER 450 (NOISE) - KITCHENER PORTUGUESE CLUB RECOMMENDATION: That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to the Kitchener Portuguese Club Inc. for their Portugal Day Celebration on Saturday June 12, th 2010, between the hours of 9 A.M. and 11 P.M., and their 40 Anniversary Celebration on Saturday August 12, 2010, between the hours of 9 A.M. and 11 P.M.. BACKGROUND: The Kitchener Portuguese Club, at 1548 Fischer Hallman Road has consistently held several festivals each year, which include outdoor performances. Residential development in the area has resulted in homes being built in closer proximity to the Club. As a result, the Club has seen fit to apply for an exemption to Chapter 450 (Noise) for their events. REPORT: It has only been in the recent past that noise concerns have been expressed with regard to the Club’s festivals. Staff have discussed the issues with representatives from the Club and they have agreed to implement measures that will reduce the impact of noise on the adjacent residentialarea. This will include directing speakers away from residential homes. They will also advise the residences of the events prior to the dates. ë ó ï Representatives of the Club have assured staff that they will cooperate with them to address any concerns that may arise during the events. Staff are not aware of any significant concerns arising from any festivals that the club held over the past 2 years. FINANCIAL IMPLICATIONS: None identified at this time. COMMUNICATIONS: No Corporate Communications required. CONCLUSION: Based on the circumstances surrounding this event, the By-law Enforcement Division does not object to this request for an exemption.
