HomeMy WebLinkAboutCRPS-10-103 - Declare Surplus - Clark Ave1 KITC~~R Corporate Services REPORT TO: DATE OF MEETING: SUBMITTED BY: PREPARED BY: WARD(S) INVOLVED: DATE OF REPORT: REPORT NO.: SUBJECT: REPORT Committee of the Whole June 14, 2010 Lesley MacDonald, City Solicitor (Ext. 2267) Lesley MacDonald, City Solicitor (Ext. 2267) Ward 3 June 8, 2010 CRPS-10-103 REQUEST TO DECLARE SURPLUS TO CITY'S NEEDS AND CONVEYANCE OF BLOCK J, PLAN 1007 -CLARK AVENUE RECOMMENDATION: That Block J, Plan 1007, in the City of Kitchener, be declared surplus to the City's needs for the purpose of conveying same to Todd Kramp and Mary Kramp; That the Mayor and Clerk be authorized to execute any documentation in this regard required by and to the satisfaction of the City Solicitor. BACKGROUND: Block J, Plan 1007 is an eight foot wide strip of land which abuts 11 -Clark Avenue. The attached OnPoint map shows the said strip of land which is located between 11 and 7 Clark Avenue. Central Mortgage and Housing Corporation was the owner of the strip of land and in 1958 agreed to convey same to John George, the owner of 11 Clark Avenue, once the Registered Plan was complete and deposited. Registered Plan 1007 was deposited in 1959 and Central Mortgage and Housing Corporation provided a Deed of Conveyance for Block J, Plan 1007 to Mr. George on December 2, 1959 but Mr. George never registered the Deed of Conveyance. When Registered Plan 1007 was registered the Registry Office recorded Block J, Plan 1007 as being owned by The Corporation of the City of Kitchener. Mr. George has been paying taxes on Block J, Plan 1007 as same is included in the roll number for his property at 11 Clark Avenue and his garage and driveway are built on Block J, Plan 1007. Mr. George recently entered into an Agreement of Purchase and Sale to sell his property at 11 Clark Avenue legally described as Lot 61, Plan 812 along with Block J, Plan 1007. During the completion of the sale transaction it was discovered that he did not have registered title to Block J, Plan 1007. Mr. George's solicitors provided us with copies of correspondence between Central Mortgage and Housing Corporation and Mr. George confirming the intent of the conveyance of Block J, Plan 1007 to Mr. George. They completed the sale of Lot 61, Plan 812 municipally known as 11 Clark Avenue to Todd Kramp and Mary Kramp by Transfer WR542185 registered on May 31, 2010. Mr. George has provided us with an Authorization and Direction authorizing us to provide a Transfer for Block J, Plan 1007 to the new owners, Todd Kramp and Mary Kramp. Mr. and Mrs. Kramp's solicitor has provided an Undertaking that upon registration of the Transfer to Mr. and Mrs. Kramp of Block J, Plan 1007, to register an application to consolidate Block J, Plan 1007 with the property owned by them municipally described as 11 Clark Avenue. The Property Management Group is in agreement with the proposed conveyance to Mr. and Mrs. Kramp. Notice to be given to the public regarding the conveyance of Block J, Plan 1007 is given by listing on the Agenda. FINANCIAL IMPLICATIONS: There is no consideration for the parcel of land to be conveyed to Mr. and Mrs. Kramp. Mr. George will be responsible for all of the costs related to the registration of Block J, Plan 1007 to Mr. and Mrs. Kramp. That the owner shall apply for and receive approval of a sign permit from the City of Kitchener." REPORT: The Committee of Adjustment met as a standing committee of City Council on Tuesday May 18, 2010, to consider an application pursuant to Chapter 680 (SIGNS), of the City of Kitchener Municipal Code.
