HomeMy WebLinkAboutDTS-10-102 - Zone Change App - ZC10/04/W/AP - 276 Woolwich St, 5 & 9 Hawkswood Dr REPORT Report To: Development and Technical Services Committee Date of Meeting: June 21, 2010 Submitted By: Alain Pinard, Interim Director of Planning Prepared By: Sarah Longstaff, Planner (519-741-3400 ext. 3270) Andrew Pinnell, Planner (519-741-2668) Ward(s) Involved: Bridgeport - Centre (Councillor John Smola) Date of Report: May 11, 2010 Report No.: DTS-10-102 Subject: ZONE CHANGE APPLICATION ZC10/04/W/AP 276 WOOLWICH STREET, 5 AND 9 HAWKSWOOD DRIVE FRED VOISIN AND ANITA VOISIN, HOLTZE FINE HOMES RECOMMENDATION: That Zone Change Application ZC10/04/W/AP for 276 Woolwich Street, 5 and 9 Hawkswood Drive (Fred Voisin and Anita Voisin, Holtze Fine Homes) for the purpose of changing the zoning from Residential Three Zone (R-3) with Holding Provision for Services and Roadworks 19HSR to Residential Three Zone (R-3), on lands specified and illustrated as the Subject Area on Map No. 1, in the City of Kitchener, be approved in the form shown in the “Proposed By-law” dated May 11, 2010, attached to report DTS-10-102 (Appendix “A”), without conditions. ïî ó ï REPORT: The subject properties are located at the intersection of Woolwich Street and Hawkswood Drive in the Bridgeport North area of Kitchener. The applicant is proposing to rezone the properties for the purpose of removing Holding Provision 19HSR. Holding Provision 19HSR was placed on the properties through a previous rezoning (Zone Change Application ZC08/29/W/AP). At that time, the Regional Municipality of Waterloo indicated the properties were within the Bridge-Lancaster Transportation Study area which was subject to a development cap that was implemented by Regional Council. A holding provision was included in the zoning on the subject lands prohibiting development of the lands for any R-3 uses until the Regional Municipality of Waterloo lifted the development cap for the Bridge-Lancaster area and a roundabout at the intersection of Bridge Street and Lancaster Street West is operational. This Holding Provision for Services and Roadworks cannot be removed until the City of Kitchener is in receipt of a letter from the Regional Commissioner of Planning, Housing, and Community Services advising that the transportation system is able to accommodate additional dwelling units. The Bridge Street and Lancaster Street West roundabout is now operational and the Region has indicated that they have no objections to the removal of the holding provision (Regional comments attached as Appendix “C”). FINANCIAL IMPLICATIONS: No new or additional capital budget requests are expected with this recommendation. COMMUNICATIONS: Preliminary circulation of the Zone Change Application was undertaken on May 10, 2010 to the Regional Municipality of Waterloo only. Notice of the public meeting to be held by the Committee of Council Dealing with Planning matters on June 21, 2010 will be advertised in The Record on May 28, 2010. A copy of this advertisement is attached as Appendix “B”. CONCLUSION: In summary, the Department of Development and Technical Services recommends that Zone Change Application ZC10/04/W/AP for 276 Woolwich, 5 and 9 Hawkswood Drive (Fred Voisin and Anita Voisin, Holtze Fine Homes), for the purpose of changing the zoning from Residential Three Zone (R- 3) with Holding Provision for Services and Roadworks 19HSR to Residential Three Zone (R-3), be approved. Schedule 129 of Appendix “A” to By-law 85-1 is hereby amended by changing the zoning applicable to the parcel of land specified and illustrated as the Subject Area on Map No. 1, in the City of Kitchener, attached hereto, from Residential Three Zone (R-3) with Holding Provision for Services and Roadworks 19HSR to Residential Three Zone (R-3). 2. Appendix “G” to By-law 85-1 is hereby amended by deleting Section 19 therefrom.
