HomeMy WebLinkAboutCRPS-10-076 - Exemption to c450 Noise - Victor Jannet - 42 Evergreen CrtREPORT REPORT TO: Finance and Corporate Services Committee DATE OF MEETING: June 7, 2010 SUBMITTED BY: Troy Speck, General Manager of Corporate Services PREPARED BY: Shayne Turner, Director of By-law Enforcement WARD(S) INVOLVED: Forest-Rockway DATE OF REPORT: May 25, 2010 REPORT NO.: CRPS-10-076 SUBJECT: EXEMPTION TO CHAPTER 450 (NOISE) - VICTOR JANNERT, 42 EVERGREEN CRESCENT RECOMMENDATION: That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to Mr. Victor Jannert for a neighbourhood barbecue to be held at his residence at 42 Evergreen Crescent, on Saturday June 19, 2010, between the hours of 7:00 P.M. and 11:00 P.M.. BACKGROUND: Mr. Jannert is planning to hold a neighbourhood barbecue at his residence on the evening of Saturday June 19, 2010. Weather permitting, Mr. Jannert is considering having a band play in their backyard during the evening. As such, he wishes to apply for an exemption to the City’s Noise By-law. REPORT: Mr. Jannert held a similar event last year and obtained a noise exemption. Staff indicate that they did receive a complaint about the outdoor music during the event. No action was taken as the exemption was in place. Staff were able to confirm that the music was turned down at approximately 11PM, which was the condition on the approved exemption. Mr. Jannert assures staff that he has informed and invited all of his neighbours in the area, and has provided the By-law Enforcement office with a copy of the notification he is distributing. Mr. Jannert will also provide information for a contact person that staff can quickly speak to during the evening if necessary. He agrees to work with staff to attend to any concern raised. é ó ï FINANCIAL IMPLICATIONS: None identified at this time. COMMUNICATIONS: No Corporate Communications required. CONCLUSION: Based on the circumstances surrounding this event, the By-law Enforcement Division does not object to this request for an exemption.
