APPEAL - REFRESHMENT VEHICLE LOCATION - 385
FAIRWAY ROAD SOUTH
RECOMMENDATION:
The Committee’s direction is requested.
BACKGROUND:
Chapter 586 (Refreshment Vehicles) of the City of Kitchener Municipal Code requires a 200
metre distance separation between a Refreshment Vehicle and a Place of Refreshment and a
400 metre distance separation between two Refreshment Vehicles. This requirement is for both
new and renewal applications.
REPORT:
A request has been received from Adam Thompson who wishes to operate a refreshment
vehicle at 385 Fairway Road South. Mr. Thompson is requesting an appeal of the Manager of
Licensing’s decision not to issue a licence for the operation of a hot dog cart at 385 Fairway
Road South. Mr. Thompson has received permission from the Canadian Tire Store at this
property.
There are currently four Places of Refreshment located within the distance separation that have
changed ownership since a hot dog cart was originally located on the property. The owners of
the affected businesses have been notified and the Manager of Licensing has received no
objections.
There has been a hot dog cart located on this property for the past several years. Canadian Tire
is requesting that Mr. Thompson take over this location.

The owners of all Places of Refreshment that have changed ownership since a hot dog cart was
originally located on the property and are within the distance separation have been notified of
the request.
