RECOMMENDATION: That the licensing hearing as approved by Council resolution on February 1, 2010 for 1776458 Ontario Inc. operating as Fusion Bar & Grill, 15 Scott Street, Kitchener be adjourned. BACKGROUND: On January 18, 2010 Report CRPS-10-013 was presented to City Council regarding the referral to a licensing hearing for 1776458 Ontario Inc., operating as Fusion Bar & Grill located at 15 Scott Street. At that time Council determined that the matter should be referred to a licensing hearing with the date and members of the tribunal to be determined. At Council’s request a temporary licence was issued to the business with an expiry date of June 30, 2010. REPORT: On April 22, 2010, Licensing staff received information from Tom Ruggle, Chief Fire Prevention Officer that Fusion Bar & Grill located at 15 Scott Street had been damaged by a fire and that the business was not reopening. A further telephone conversation with the owner of the bar, Abdool Abdul indicated that he was not intending to reopen in the downtown core. A recent inspection by the Licensing Inspector revealed that the business was closed and that all signs advertising Fusion Bar & Grill had been removed. Based on the information available, it is staff’s opinion that the Licensing Hearing should be adjourned at this time. If the owner of the establishment relocates and applies for a new business licence, the matter will be reviewed by the Manager of Licensing before a new licence is issued.
