RECOMMENDATION:
For information.
BACKGROUND:
Staff report DTS-10-127 was presented to the Development and Technical Services Committee
on June 21, 2010. At that meeting, staff were requested to resolve three issues pertaining to
the proposed demolition, which include;
1. That all buildings and structures, including the inground pool, are removed at the time of
demolition of the residential structures, and
2. That any changes to the grading as a result of the removal of any of the buildings or
structures on either property does not adversely affect any adjacent properties, and
3. That any issues which may arise as a result of the proposed "controlled burn" by the City
of Kitchener Fire Department are resolved prior to final approval of the demolition control
application.
The Committee referred to the decision of DTS-10-127 to the regularly scheduled Council
meeting on June 28, 2010 and asked Staff to provide more information on the issues identified
above.
REPORT:
On June 22, 2010, at the request of Planning staff, the Owner has provided an Undertaking to
the City of Kitchener which resolves issues number 1 and 2 above (See Appendix "A"). It is
Planning staff's opinion that this Undertaking ensures that the Planning concerns identified by
the Committee have been resolved. We understand that Fire Department staff will be providing
follow up information on the proposed "controlled burn' directly to Council.
FINANCIAL IMPLICATIONS:
No new or additional capital budget requests are expected with this recommendation.
COMMUNICATIONS:
None at this time.
CONCLUSION:
The Owner has provided an Undertaking to remove all structures, buildings, and the inground
pool at the time of demolition of the residential structures and has agreed to resolve any
adverse grading issues that may arise as a result of the demolitions. Planning staff are of the
opinion that the planning issues identified by Committee on June 21, 2010 have been satisfied
and that the demolition is appropriate and further advise that the recommendation of staff report
DTS-10-127 is appropriate.

I, Ken Draumtsekas, authorized signing officer of Krissons Holdings Limited hereby undertake as follows:
1. That at the time of the demolition of the residential buildings located at 92 and 96 Woolwich
Street the City of Kitchener, Krissons Holdings Limited, (fibs "owner"} of the subject property, agrees
to remove all buildings and structures including the inground pool, on both properties mentioned
above.
2. That the finished final grading does not adversely affect the adjaeent properties, including 92
Woolwich Street where are existing shed building appears to hold/support a change in grade. At the
time that the shed is demolished the foundation of the shed will remain along the side property line to
ensure the embankment is stabilized. That if the retaining wall fails or shaves signs of failure the
retaining wall will be repaired or replaced by the droner at its expense.
