SUBJECT: REPEAL CHAPTER 134 (LOTTERY LICENSING OFFICER)
OF THE CITY OF KITCHENER MUNICIPAL CODE
RECOMMENDATION:
That Chapter 134 of The City of Kitchener Municipal Code (Lottery Licensing Officer) be
repealed.
BACKGROUND:
Provincial Lottery Regulations permit a Municipal Council to appoint a Lottery Licensing Officer
to act on their behalf to oversee lottery regulations and act as a liaison with the Alcohol and
Gaming Commission of Ontario (AGCO).
REPORT:
In the past, appointment of the City's Lottery Licensing Officer was made under Chapter 134 of
the municipal code with the City Clerk being appointed. On January 26, 2009 Council adopted
a new Chapter 554 (Lotteries) which appointed the Manager of Licensing as the Lottery
Licensing Officer for the municipality instead of the City Clerk. This has resulted in Chapter 134
being in conflict with this change and, therefore, should be repealed.
