HomeMy WebLinkAboutCRPS-10-116 - Encroachment Agmt - 1760 Strasburg RoadREPORT TO: Committee of the Whole DATE OF MEETING: June 28, 2010 SUBMITTED BY: Jennifer Sheryer, Assistant City Solicitor PREPARED BY: Sherry Handsor, Legal Assistant WARD(S) INVOLVED: 4 DATE OF REPORT: June 22, 2010 REPORT NO.: CRPS-10-116 SUBJECT: ENCROACHMENT AGREEMENT REQUEST - 1760 STRASBURG RD -TEMPORARY PARKING LOT OVER CITY OWNED LAND RECOMMENDATION: "That, subject to obtaining all necessary staff approvals, the Mayor and Clerk be authorized to execute an Encroachment Agreement, satisfactory to the City Solicitor, with the property owner(s) and any mortgagee(s) of the property municipally known as 1760 Strasburg Rd. to permit the installation of a temporary parking lot over a portion of City owned land as described in PIN 22607-0040 LT, being an approximate area of .32 acres; and further, That Council waive the requirement of entering into a site plan agreement as set out in Policy I-995 that deals with temporary parking lots provided that such use does not extend beyond February 2011." BACKGROUND: J.T. Bakeries Inc. is the owner of the building located at 1760 Strasburg Rd. They have an increased sales expectation between the months of August 2010 and January 2011. This presumed sales growth will generate upwards of 50 to 75 additional jobs in their facility and they require additional parking spaces for this peak period of production. REPORT: The proposed additional parking area is approximately .32 acres and will be located on City owned land adjacent to 1760 Strasburg Rd. as shown on the attached plan. The City owned land is proposed to be used for the future McBrine Dr. extension. J.T. Bakeries Inc. would like to use a portion of these lands as an auxiliary parking lot for a period of approximately six months during their peak production period. J.T. Bakeries Inc. will be responsible for all costs to construct and maintain the temporary parking area and will be required to restore the area to City standards once the parking period has expired. They will also be required to pay a monthly 10-1 rental fee to the City. This request is still being discussed at a staff level. Final staff recommendations will be included in the encroachment agreement. The Supervisor of Site Development supports waiving Policy I-995 which would normally require the site to go through site plan approval due to the extremely short time proposed for use of this lot. FINANCIAL IMPLICATIONS: Staff have determined an appropriate fee based on the nature and extent of the proposed use of the City's land. CONCLUSION: This item is still being discussed at a staff level. Final staff recommendations will be included in the encroachment agreement.
