HomeMy WebLinkAboutDTS-10-136 - Easement Conveyance to Hydro OneJ- e ~opn~ent~ ---~5 REPORT REPORT TO: Committee of the Whole DATE OF MEETING: June 28, 2010 SUBMITTED BY: Steve Allen, Manager Design and Approvals PREPARED BY: Steve Allen, Manager Design and Approvals (741-2584) WARD(S) INVOLVED: Ward 5 DATE OF REPORT: June 23, 2010 REPORT NO.: DTS -10-136 SUBJECT: Declare a Portion of Land Surplus for the Conveyance of an Easement to Hydro One RECOMMENDATION: That council enact the following resolution: "That the lands as set out on the attached Schedule "A" and legally described as Part of Block 143, Plan 1600, to be further described on a Reference Plan, be declared surplus to the City's needs and conveyed to Hydro One for purposes of creating an easement over the subject lands; That Legal Services be directed to transfer a permanent easement to Hydro One to access an existing easement on the lands; That the Mayor and Clerk be authorized to execute the necessary documentation to effect this transaction, said documentation to be to the satisfaction of the City Solicitor." BACKGROUND: The City is proceeding with modifications to an existing stormwater management pond located on City owned lands in the Forest West Park area. The modifications are part of the Infrastructure Stimulus Funding grant (ISF) and involve the creation of a larger pond for the purposes of controlling stormwater quality as well as quantity. Hydro One owns and operates power lines within an easement over the City owned lands. The easement agreement requires that any works performed by the City over the granted easement be subject to Hydro One review and approval. As the pond is being enlarged, Hydro One has requested that the easement be widened in the area of the pond in order to facilitate the movement of Hydro One maintenance vehicles around the new pond. 5-1 REPORT: Hydro-One has requested that the easement be widened in the area of the pond in order to facilitate the movement of Hydro One maintenance vehicles around the new pond. The new easement is contained entirely on City owned land and is approximately 6.Om by 50.Om It is a required formality for the City to declare the lands surplus in order to allow the conveyance of an easement. FINANCIAL IMPLICATIONS: The financial implications would be the cost of a Reference Plan and the registration of the Easement and will be paid for from "CAP/MISC LAND -CITY STS INC SURVEY" -Internal Order # 59500187. COMMUNICATIONS: N/A CONCLUSION: Hydro One approval for the modifications to the SWM pond are subject to the granting of the wider easement in the vicinity of the existing pond. Staff recommend that the wider easement be granted.
