HomeMy WebLinkAboutCRPS-10-131 - Exemption to Chapter 450 Noise - K-W Oktoberfest EventsREPORT REPORT TO: Finance and Corporate Services Committee DATE OF MEETING: August 23, 2010 SUBMITTED BY: Troy Speck, General Manager of Corporate Services PREPARED BY: Shayne Turner, Director of By-law Enforcement WARD(S) INVOLVED: All DATE OF REPORT: August 10, 2010 REPORT NO.: CRPS-10-131 SUBJECT: EXEMPTION TO CHAPTER 450 (NOISE) - K-W OKTOBERFEST EVENTS RECOMMENDATION: That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to K-W Oktoberfest Inc. for a series of events being held at various clubs between October 2 and October 16, 2010, as outlined in the letter from K-W Oktoberfest Inc., dated July 14, 2010, attached to Report CRPS-10-131. BACKGROUND: K-W Oktoberfest Inc. is requesting an exemption to Chapter 450 (Noise) of the City’s Municipal Code for a series of events that are being held at 8 clubs, during the 2010 Oktoberfest th festivities, running from October 2nd to 16, 2010. A copy of their request is attached. REPORT: Staff within the By-law Enforcement Division reports that the number of noise complaints relating to these events over the past several years has been minimal at best. Typically, there appears to be a large a degree of acceptance by City residents to these events, given their vast popularity and broad community benefits. The level of cooperation that staff has received from event organizers has been positive. In the recent past, concerns had been raised with respect to certain events held at the Aud as part of the Karlsberghaus venue. It is anticipated that there will not be the type of event this year that has raised such concerns in the past. Having said this, Aud staff has indicated that ì ó ï they will be communicating with area residents in advance of any event that could have an above average impact, although none are anticipated at this time. FINANCIAL IMPLICATIONS: None identified at this time. COMMUNICATIONS: No Corporate Communications required. CONCLUSION: Based on the circumstances surrounding this annual request, the By-law Enforcement Division does not object to this request for an exemption.
