Gosse, Director of Legislated Services/City Clerk PREPARED BY: Patricia Harris, Manager of Licensing WARD(S) INVOLVED: 1 DATE OF REPORT: August 11, 2010 REPORT NO.: CRPS-10-132 SUBJECT: ISSUANCE OF EXTENSION OF USE REFRESHMENT VEHICLE LICENCE - KENNY'S BAR & GRILL - 347 LANCASTER STREET WEST RECOMMENDATION: That an Extension of Use Refreshment Vehicle Licence be granted to Kenny’s Bar & Grill located at 347 Lancaster Street West with the following condition: The refreshment vehicle must be closed and removed no later than 11 p.m. Sunday to Thursday and no later than 1 a.m. on Friday and Saturday. BACKGROUND: Schedule ‘A’ – Business Licence Procedure of Chapter 586 (Refreshment Vehicles) states in Section 1 that upon receipt of a complete licence application the Manager of Licensing shall either issue or renew a licence hereunder or shall refer the matter to Council or a Committee of Council where appropriate. REPORT: An Application for a Grant of Licence has been received from Romana Vignjevic owner of Kenny’s Bar & Grill (formerly Café Azzuro) located at 347 Lancaster Street West to operate a hot dog cart as an extension to their place of refreshment. As the result of a Licensing Hearing that was held on July 14 & 15, 2008 several conditions were placed on the Place of Refreshment licence for this location. They include: 1. All outside patios must be closed and vacated no later than 11 pm Sunday to Thursday and no later than 1 a.m. on Friday and Saturday. 2. The front door to 347 Lancaster Street West shall be used as the main entrance for the business. 3. All patrons must vacate the premises which included the building and outside areas no later than 2:45 a.m. and only the business licensee and paid staff of the business may remain. ïð ó ï 4. During business hours, the licensee shall ensure that the outside areas of the premises are regularly monitored to mitigate issues and/or problems that may affect the neighbours of the business. Staff has recently received a number of noise complaints regarding this property. They have included barking dogs and loud music. In all but one case, when staff arrived there was no evidence of loud music or barking dogs. In order to alleviate any concerns the neighbouring residents may have with the addition of a hot dog cart to this establishment and to align it with the conditions for the Place of Refreshment licence, staff is recommending that the hot dog cart be closed and removed no later than 11 p.m. Sunday to Thursday and no later than 1 a.m. on Friday and Saturday. FINANCIAL IMPLICATIONS: None COMMUNICATIONS: The owner of the establishment has been notified of this meeting and a copy of this report has been forwarded to the owner of Kenny’s Bar & Grill.
