HomeMy WebLinkAboutCouncil - 2010-08-23 SSPECIAL COUNCIL MINUTES AUGUST 23, 2010 CITY OF KITCHENER A special meeting of City Council was held at 11:37 a.m. this date, chaired by Mayor C. Zehr with all members present except Councillor G. Lorentz. Notice of this meeting had been previously given to all members of Council by the City Clerk pursuant to Chapter 25 (Council Procedure) of the Municipal Code. Council considered Corporate Services Department report CRPS-10-138 (L. MacDonald) requesting authorization to convey title of the Transit Terminal and the Transit Garage to the Region of Waterloo. Moved by Councillor C. Weylie Seconded by Councillor J. Smola "That the Mayor and Clerk be authorized to execute the necessary documentation, satisfactory to the City Solicitor, to convey the actual title to the Transit Terminal at 15 Charles Street West and the Transit Garage at 250 Strasburg Road, more specifically described in Corporate Services Department report CRPS-10-138, to the Regional Municipality of Waterloo which assumed ownership of these properties by passage of Regional Municipality of Waterloo By- laws 99-070 and 01-077 regarding transit." Carried. Moved by Councillor K. Galloway Seconded by Councillor B. Vrbanovic "That an in-camera meeting of City Council be held this date to consider a personal matter, two litigation /potential litigation matters, three land acquisition /disposition matters and three matters subject to solicitor-client privilege." Carried. The meeting then recessed at 11:39 a.m. and re-convened at 5:26 p.m., chaired by Mayor C. Zehr and with all members present except Councillor G. Lorentz. Mayor C. Zehr advised that Andrin Investments has requested an amendment to the Agreement of Purchase and Sale regarding the Centre Block property to adjust the timing of the construction of the sales pavilion. He further advised that discussion took place this date in closed session in order to receive advice from the City Solicitor. Ms. L. MacDonald, City Solicitor, circulated a recommendation for Council's consideration regarding an amendment to the Agreement of Purchase and Sale between the City and Andrin Investments Ltd. Moved by Councillor J. Smola Seconded by Councillor K. Galloway "That the Mayor and Clerk be authorized to execute an amendment to the Agreement of Purchase and Sale with Andrin Investments Limited to adjust the timing of the commencement of the construction of the sales pavilion such that it shall commence no later than August 31, 2010, and be completed no later than November 30, 2010; said amendment to be satisfactory to the City Solicitor." Carried. Council considered a recommendation arising from the Finance & Corporate Services Committee meeting concerning a noise exemption request from The Father's House Church. Moved by Councillor B. Vrbanovic Seconded by Councillor J. Smola "That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to The Father's House Church for their "Love Your City" event at Victoria Park on August 28, 2010, between the hours of 11:00 a. m. and 5:00 p. m." Carried. SPECIAL COUNCIL MINUTES AUGUST 23, 2010 - 222- CITY OF KITCHENER Council considered a recommendation arising from the Finance & Corporate Services Committee meeting concerning a noise exemption request from the Doon Pioneer Park Community Association. Moved by Councillor B. Vrbanovic Seconded by Councillor J. Smola "That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to the Doon Pioneer Park Community Association for their annual outdoor concert and festival to be held on September 11, 2010, between the hours of 2:00 p.m. and 10:00 p.m. " Carried. Council considered a recommendation arising from the Finance & Corporate Services Committee meeting concerning a noise exemption request from Kitchener Masjid. Moved by Councillor B. Vrbanovic Seconded by Councillor J. Smola "That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to The Kitchener Masjid, at 1017 Victoria Street North for their Eid Carnival on September 10 or 11, 2010, between the hours of 10:00 a. m. and 8:00 p. m." Carried. Council considered a recommendation arising from the Finance & Corporate Services Committee meeting concerning a fair or exhibition gaming event licence for Kitchener-Waterloo Oktoberfest. Moved by Councillor B. Vrbanovic Seconded by Councillor J. Smola "That the City of Kitchener has no objection to a Provincial Lottery Licence being issued to Kitchener-Waterloo Oktoberfest to hold a Fair or Exhibition Gaming Event from October 8 to October 16, 2010 at Bingeman's Marshall Hall, 425 Bingemans Centre Drive, Kitchener." Carried. Council considered a recommendation arising from the Finance & Corporate Services Committee meeting concerning an extension of use request for a refreshment vehicle licence from Kenny's Bar & Grill. Moved by Councillor B. Vrbanovic Seconded by Councillor J. Smola "That an Extension of Use Refreshment Vehicle Licence be granted to Kenny's Bar & Grill, located at 347 Lancaster Street West, with the following condition: 1. The refreshment vehicle must be closed and removed no later than 11:00 p.m. Sunday to Thursday and no later than 1:00 a.m. on Friday and Saturday." Carried. Moved by Councillor K. Galloway Seconded by Councillor C. Weylie "That leave be given the Mover and Seconder to introduce the following by-laws for three readings and that the same be taken as read a first, second and third times, be finally passed and numbered serially by the Clerk. (a) Being a by-law to exempt certain lands from Part Lot Control -Part Block 58, Registered Plan 58M-190 and Part Block 37, Registered Plan 1799 - Briarmeadow Drive. (By-law No. 2010-138) SPECIAL COUNCIL MINUTES AUGUST 23, 2010 - 223- CITY OF KITCHENER (b) Being a by-law to exempt certain lots from Part Lot Control -Block 25, Registered Plan 1822 -Wilderness Drive. (By-law No. 2010-139) (c) Being a by-law to exempt certain lots from Part Lot Control -Part Block 6, Registered Plan 58M-367 -Zeller Crescent. (By-law No. 2010-140) (d) Being a by-law to exempt certain lots from Part Lot Control -Part Block 4, Registered Plan 58M-367 -Zeller Crescent. (By-law No. 2010-141) (e) To confirm all actions and proceedings of the Council. (By-law No. 2010-142)." Carried. On motion the meeting adjourned at 5:28 p.m. MAYOR CLERK
