HomeMy WebLinkAboutCRPS-10-142 - Noise Exemption - Koi Music FestivalREPORT TO: DATE OF MEETING: SUBMITTED BY: PREPARED BY: WARD(S) INVOLVED: DATE OF REPORT: REPORT NO.: Mayor Zehr and Members of Council September 7, 2010 Troy Speck, General Manager of Corporate Services Shayne Turner, Director of By-law Enforcement Wards 1 and 6 August 31, 2010 CRPS-10-142 SUBJECT: EXEMPTION TO CHAPTER 450 (NOISE) - KOI MUSIC FESTIVAL RECOMMENDATION: That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to Cory Grossman, for the KOI Music Festival, on September 18, 2010, for outdoor music at 2 locations, The Hive, at 200 King Street East, between the hours of 1:00 P.M. and 11:00 P.M., and One Eyed Jacks, at 45 Duke Street West, between the hours of 1:00 P.M. and 10:00 P.M.. BACKGROUND: The KOI Music Festival is happening on Saturday September 18, 2010, at several venues throughout downtown Kitchener. The majority of locations are indoor venues, with the exception of The Hive and One Eyed Jacks. The Festival organizer is requesting an exemption to Chapter 450 (Noise) for the 2 outdoor venues. REPORT: The event at The Hive is proposed for their rear parking lot area. At One Eyed Jacks, they will be using their outdoor patio area, and the music will be acoustic in nature, thus less amplified. The Hive has received 1 previous noise exemption approval earlier this year for a cancer fund raiser. One complaint was received during that event. Overall, the organizers at that time were able to put controls in place to help mitigate the noise in the area. Staff will work with the event organizer to put similar controls in place for the September 18th event. 6-1 FINANCIAL IMPLICATIONS: None identified at this time. COMMUNICATIONS: No Corporate Communications required. CONCLUSION: Based on the circumstances surrounding this event, the By-law Enforcement Division does not object to this request for an exemption.
