HomeMy WebLinkAboutCRPS-10-150 - Exemption to Chapter 450 (Noise) - Stahle Construction Inc - 500 Fairway Rd SREPORT REPORT TO: Finance and Corporate Services Committee DATE OF MEETING: September 13, 2010 SUBMITTED BY: Troy Speck, General Manager of Corporate Services PREPARED BY: Shayne Turner, Director of By-law Enforcement WARD(S) INVOLVED: Fairview-Gateway DATE OF REPORT: September 7, 2010 REPORT NO.: CRPS-10-150 SUBJECT: EXEMPTION TO CHAPTER 450 (NOISE) - STAHLE CONSTRUCTION INC. - 500 FAIRWAY ROAD RECOMMENDATION: That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to Stahle Construction for some overnight construction work to be carried out over 6-7 nights between September 14 and September 30, 2010, subject to the following conditions: 1. That the roof work be limited to 2 mornings during the approved time period, and such work shall not start before 4AM on each of the 2 mornings; and further, 2. That the contractor shall give notice of the roof work, to the adjacent residential area, in advance of the 2 mornings when the work will be undertaken. BACKGROUND: Stahle Construction Inc. has been contracted to undertake some renovation work at the commercial plaza at 500 Fairway Road. This work involves re-glazing of store front windows and some roof re-construction. Due to the nature of this work, the contractor has identified that certain elements of this work cannot be undertaken while certain stores are open to the public. The contractor is proposing to undertake some work during the overnight hours on certain days in the coming weeks. As such, the contractor is requesting an exemption from Chapter 450 (Noise). A copy of their request is attached. í ó ï REPORT: Stahle Construction advises that the window replacement phase will be completed on or about th . Some of this work has already been completed during overnight hours and September 17 involves the minimal use of equipment that may cause high levels of noise. As such, it is not anticipated that the completion of this work will result in any major impacts. The portion of the raised roof installation that requires overnight activity will take place over a 2 th night period. This part of the project is now scheduled to start on September 14, or after, depending on the weather. The contractor is requesting for the exemption period to extend to th October 15, just to allow for any weather associated contingencies. However, staff are th suggesting that the time period be limited to September 30. Nonetheless, the overnight work on the roof will still be confined to 2 nights. Further, the contractor advises that the roof work will not start before 4AM on each of the 2 days, which means that the exemption required will be for approximately 3 hours on each of the 2 mornings. This plaza is in a highly commercial area, however there is a residential area behind the plaza. The contractor is committing to posting notices in the area in advance of the roof work being undertaken, once such dates have been determined with certainty. FINANCIAL IMPLICATIONS: None identified at this time. COMMUNICATIONS: No Corporate Communications required. CONCLUSION: Based on the circumstances surrounding this project, and the need for some overnight work, the By-law Enforcement Division does not object to this request for an exemption.
