DATE OF MEETING: October 4, 2010
SUBMITTED BY: Troy Speck, General Manager of Corporate Services
PREPARED BY: Shayne Turner, Director of By-law Enforcement
WARD(S) INVOLVED: Chicopee-Garnd River
DATE OF REPORT: September 29, 2010
REPORT NO.: CRPS-10-160
SUBJECT: EXEMPTION TO CHAPTER 450 (NOISE) - 480 PROSPECT
AVENUE
RECOMMENDATION:
That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to
Debbie Reider for a benefit barbecue being held at her residence at 480 Prospect Avenue, on
October 23, 2010, between the hours of 2:00 PM and 11:00 PM.
BACKGROUND:
Ms. Debbie Reider is planning to hold a barbecue at her residence as a means of gathering
donations of goods for a family member who suffered a significant loss due to a recent house
fire. She is planning to have some recorded music played in her backyard during the event. As
such, she is requesting an exemption from Chapter 450 (Noise) for the event.
REPORT:
Staff have confirmed that the donations will involve items such as food and clothing and not
monetary assistance which could involve a licensing component. Ms. Reider does not believe
that the music being played will be an issue, however she wanted to ensure that she sought the
relevant approval in order to avoid any issues during the event. She has indicated that all her
adjacent neighbours have been informed of the upcoming event.
FINANCIAL IMPLICATIONS:
None identified at this time.
COMMUNICATIONS:
No Corporate Communications required.
CONCLUSION:
Based on the circumstances surrounding this event, the By-law Enforcement Division does not
object to this request for an exemption.
