DTS-10-163 - OVERLEA DRIVE - ON-STREET PARKING The Committee considered Development & Technical Services Department report DTS-10- 163, dated October 14, 2010, recommending a parking prohibition on a portion of the west side of Overlea Drive. On motion by Councillor J. Gazzola- it was resolved: “That the Uniform Traffic By-law be amended to prohibit parking on the west side of Overlea Drive from a point 156m south of Westmount Road to a point 22m south thereof.” 2. DTS-10-165 - BELMONT AVENUE WEST - NO STOPPING ANYTIME The Committee considered Development & Technical Services Department report DTS-10- 165, dated October 14, 2010, recommending ‘No Parking Anytime’ on a portion of Belmont Avenue West. On motion by Councillor J. Gazzola - it was resolved: “That the Uniform Traffic By-law be amended to change the ‘No Stopping 4:30 p.m. – 5:30 p.m. Monday to Friday’ regulation to ‘No Stopping Anytime’ on the north side of Belmont Avenue West, from a point 200m east of Glasgow Street to a point 40m east thereof.” 3. DTS-10-177 - SUR-GARD SYSTEM III VIRTUAL RECEIVER PURCHASE The Committee considered Development & Technical Services Department report DTS-10- 177, dated September 23, 2010, recommending the purchase of Sur-Gard System III Virtual Receiver. On motion by Councillor J. Gazzola - it was resolved: “That the purchase of Sur-Gard System III Virtual Receiver be approved from a single source provider, namely digital Security Controls (DSC).” 4. DTS-10-178 - 77051 MULTINET MONITORING UPGRADE RECEIVER PURCHASE The Committee considered Development & Technical Services Department report DTS-10- 178, dated September 23, 2010, recommending the purchase of the 7705i MultiNet Monitoring Receiver. CITY OF KITCHENER DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES NOVEMBER 8, 2010 - 99 - CITY OF KITCHENER 4. DTS-10-178 - 77051 MULTINET MONITORING UPGRADE RECEIVER PURCHASE, CONT’D Councillor Lorentz requested that Mr. Beckett Provide a report on Direct Detect for next week’s Council meeting, containing year over year figures. Mr. Beckett advised that currently Direct Detect is not a stand alone business; however, the technology is getting better. Currently Direct Detect does have customers in the other municipalities for which Kitchener provides Fire Dispatch. On motion by Councillor J. Gazzola - it was resolved: “That the purchase of 7705i MultiNet Monitoring Receiver be approved from a single source provider, namely AES Corporation IntelliNet, for alarm monitoring.” 5. DTS-10-180 - FREDERICK STREET, BRUCE STREET TO RIVER ROAD - CLASS B ENVIRONMENTAL ASSESSMENT The Committee considered Development & Technical Services Department report DTS-10- 180, dated October 22, 2010, explaining that the Region is completing a Schedule B Class Environmental Assessment for road improvements on Frederick Street between Lancaster Street and river Road. The report notes that Frederick Street between Lancaster Street and Bruce Street is under the jurisdiction of the Region and between Bruce Street and River Road is within the jurisdiction of the City. In the report staff recommends that the City endorse the Schedule B Class Environmental Assessment. On motion by Councillor J. Gazzola - it was resolved: “That the Region of Waterloo’s execution of a Schedule B Class Environmental Assessment on behalf of the City of Kitchener for a road diet on Frederick Street between Bruce Street and River Road be endorsed.” 6. DTS-10-181 - DEMOLITION CONTROL APPLICATION DC10/08/F/GS 1650, 1670, 1690 & 1720 FISHER HALLMAN ROAD DEERFIELD HOMES The Committee considered Development & Technical Services Department report DTS-10- 181, dated October 27, 2010, recommending demolition of 4 houses municipally known as 1650, 1670, 1690 and 1720 Fischer Hallman Road. The report explains that the properties are subject to the City-initiated Interim Control By-law 2010-032 and are also subject to Zone Change Application ZC08/36/F/EB which has been appealed to the Ontario Municipal Board. At this time the owner can not make an application for new development until the Interim Control By-law is repealed by Council. Councillor Galloway questioned whether notice of this demolition application was provided to the neighbours. Mr. Pinard advised that the standard practice is to provide notice to residents within 60m of the property. Councillor Galloway questioned why there are 2 different distances for circulating notices of planning applications. Mr. Willmer advised that the circulation distance for zone changed and official plan amendments is 120m; however, since notice of demolition control applications is not required under the Planning Act, staff provides the same circulation distance as for minor variance and consent applications. Councillor Galloway questioned why, in this case, staff is recommending approval of the demolition application when the future use of the property is unknown. Mr. Pinard responded that staff does contemplate future development on this property. Also, there have been break- ins at these properties and people who are not legal tenants have been making use of these houses. Mr. Pinard also advised that there are times when staff recommends a 2 year rebuild condition, usually in the case where the loss of the building would leave a big hole in an existing development. CITY OF KITCHENER DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES NOVEMBER 8, 2010 - 100 - CITY OF KITCHENER 6. DTS-10-181 - DEMOLITION CONTROL APPLICATION DC10/08/F/GS 1650, 1670, 1690 & 1720 FISHER HALLMAN ROAD DEERFIELD HOMES, CONT’D On motion by Councillor J. Gazzola - it was resolved: “That Demolition Control Application DC10/08/F/GS requesting permission to demolish four (4) single detached dwelling units municipally addressed as 1650 Fischer Hallman Road and legally described as German Company Tract Pt lot 158 and 1670 Fischer Hallman Road and legally described as German Company Tract Pt lot 158, RP 58R- 13970 PT 3 and 1690 Fischer Hallman Road and legally described as German Company Tract Pt lot 158 and 1720 Fischer Hallman Road and legally described as German Company Tract Pt lot 158, be approved without conditions.” 7. DTS-10-182 - PROCEDURE FOR GIVING PUBLIC NOTICE FOR PLANNING ACT APPLICATIONS The Committee considered Development & Technical Services Department report DTS-10- 182, dated October 26, 2010, recommending a review of Council Policy I-1095 (Public Participation in the Planning Process) to determine if there should be any updates or revisions, including the use of social media tools. Councillor Galloway questioned whether the review will include an examination of how letters are sent and the distance for neighbourhood circulations. She also commented that the review should include examining ways to insure the public notice letters are received. Councillor Lorentz questioned whether this review will include newspaper advertising. He directed that staff provide the annual cost for newspaper advertising. Mr. Pinard advised that the review will include those actions taken above and beyond the statutory requirements; also, use of social media will be investigated. Mayor Zehr and Councillor Vrbanovic directed that staff investigate whether the “Kitchener Citizen” will meet the legislative requirements for providing notice. Councillor Vrbanovic also stated that staff needs to communicate more clearly on advising the public about what is actually happening. On motion by Councillor J. Gazzola- it was resolved: “That Planning staff review Council Policy I-1095 (Public Participation in the Planning Process) to determine if there should be any updates or revisions; and, That the use of social media tools be explored as part of the review; and further, That Planning staff report to Council in the spring of 2011 with any recommended changes to Council Policy I-1095.” 8. DTS-10-183 - DEMOLITION CONTROL APPLICATION DC10/11/B/ATP 1000 BLEAMS ROAD KITCHENER-WATERLOO CHRISTIAN FELLOWSHIP CHURCH The Committee considered Development & Technical Services Department report DTS-10- 183, dated October 27, 2010, recommending approval of the Demolition Control Application for 1000 Bleams Road without conditions. The purpose of the demolition is to allow space for the church to construct an auditorium addition. Councillor Galloway questioned whether the public was advised as to what is actually going to be constructed on the property and Mr. Pinard advised that he is not sure of what was included in the written notification. CITY OF KITCHENER DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES NOVEMBER 8, 2010 - 101 - CITY OF KITCHENER 8. DTS-10-183 - DEMOLITION CONTROL APPLICATION DC10/11/B/ATP 1000 BLEAMS ROAD KITCHENER-WATERLOO CHRISTIAN FELLOWSHIP CHURCH, CONT’D On motion by Councillor J. Gazzola - it was resolved: “ That Demolition Control Application DC10/11/B/ATP requesting permission to demolish one (1) single detached dwelling located at 1000 Bleams Road, owned by the Kitchener-Waterloo Christian Fellowship, legally described as Block 137 or Registered Plan 1648, be approved without conditions.” 9. DTS-10-174 - TELECOMMUNICATION TOWER AND ANTENNA PROTOCOL The Committee considered Development & Technical Services Department report DTS-10- 174, dated October 27, 2010, respecting the review of the Telecommunication Tower and Antenna Protocol by Industry Canada. On motion by Councillor J. Gazzola - it was resolved: “That further to the Council resolution of March 22, 2010, the Telecommunication Tower and Antenna Protocol as reviewed and commented on by Industry Canada, be approved in the form shown in the report dated October 27, 2010, attached to Development and Technical Services Department report DTS-10-174, with out conditions.” 10. DTS-10-158 - HIGHLAND CRESCENT - ON-STREET PARKING Councillor J. Gazzola took the chair at this time, as requested by Councillor C. Weylie. The Committee considered Development & Technical Services Department report DTS-10- 158, dated October 26, 2010, recommending a parking prohibition on a portion of the west side of Highland Crescent. The Committee was in receipt this date of e-mail correspondence from a tenant at 180 Highland Crescent in support of the staff recommendation. Mr. McBride presented the report, advising that staff undertook a survey of the residents on Highland Crescent as to whether or not they wanted greater parking restrictions on the street. Although the majority of respondents did not want greater restrictions, a number of residents asked staff to look closer at traffic problems at Wycliffe Place and the driveway at 180 Highland Crescent. Mr. McBride advised that the recommendation in the staff report will eliminate 6 parking spaces. Ms. MacDonald-Young and Ms. Taylor addressed the Committee about their concerns with the staff recommendation and about the process undertaken by staff. They advised that staff distributed a survey to 178 residents at 5 properties along Highland Crescent and the results of the survey showed that 60% of those residents were in support of leaving the on-street parking situation as it is. Yet, in spite of being told that no changes in the on-street parking situation would be recommended, this staff report is before you tonight. Ms. MacDonald-Young and Ms. Taylor noted that their second concern is the fact that staff provided the survey results and recommendations to the wrong councillor, which left Councillor Weylie without adequate time to address this matter with staff. With respect to the recommendation in the staff report, the delegation was of the opinion that staff’s position is subjective and unsubstantiated; that Wycliffe Place already has a very generous visual access; and, there is not history of accidents in this area of Highland Crescent. Further, ample on-street parking is needed in this area of condominiums that have limited guest parking. CITY OF KITCHENER DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES NOVEMBER 8, 2010 - 102 - CITY OF KITCHENER 10. DTS-10-158 - HIGHLAND CRESCENT - ON-STREET PARKING, CONT’D The delegation offered a compromise respecting 180 Highland Crescent, suggesting designation of a no-parking area, the length of one car, on either side of the driveway at 180 Highland Crescent. They also recommended relocation of the super mailbox which is currently located close to the driveway at 180 Highland Crescent. Ms. MacDonald-Young and Ms. Taylor advised that they have letters from 3 other residents of Highland Crescent in opposition to removing any on-street parking on Highland Crescent. Ms. E. Peidl was in attendance and advised the Committee that she does not want all the parking removed; however, she noted that there is a safety issue to be addressed. She advised that she was once in a minor accident when trying to turn left out of the driveway at 180 Highland Crescent because she could not clearly see all the traffic on Highland Crescent. She noted that when trucks are parked on the street, up to the driveway, it is impossible to see past these trucks. She asked that consideration be given to removing the on-street parking spaces, one on each side of the driveway, to provide the ability to see on-coming traffic. Ms. Peidl stated she was not certain whether 1 car length would be sufficient. Councillor Weylie questioned whether vehicles are speeding and Ms. Peidl responded that speeds are the same as anywhere else in the City. Ms. D. Bauer addressed the Committee stating her agreement with the first delegation. She advised that her street has many multi-residential developments and the street is always full of cars. She stated that she strongly believes that the residents need all of these parking spaces for visitors. A brief discussion followed which included some concern about potential liability on the City’s part if the City does not do anything to address these sight line issues and an accident occurs. Councillor Weylie noted that between 180 Highland Crescent and Highland Road, there is a sign stating no parking and Mr. McBride advised that he does not know why it is there and he will have it removed. Councillor Weylie stated that there seems to be so many concerns: with the super mailbox, monitoring speeds, etc. She suggested that By-law enforcement needs to be out in this area more often. Councillor Weylie also suggested that elimination of 1 parking space on either side of the driveway at 180 Highland Crescent should address concerns with sight lines and the super mailbox could be moved. She recommended that it seems no further action is necessary. Mayor Zehr put forward a motion to defer consideration of any parking prohibition on Highland Crescent; that staff investigates what more needs to be done at Wycliffe Place and what would be an appropriate distance on either side of the driveway at 180 Highland Crescent, to provide adequate sight lines for traffic exiting that driveway. On motion by Mayor C. Zehr.- it was resolved: “That consideration of any additional areas for parking prohibition on Highland Crescent be referred to the Council meeting of November 15, 2010 ; and, That staff investigate and recommend to Council an appropriate amount of space on either side of the driveway at 180 Highland Crescent in which parking must be prohibited on Highland Crescent in order to provide appropriate sight lines for vehicles to safely enter into the right-of-way; and further, That staff re-examine the intersection of Wycliffe Place and Highland Crescent to determine if there is a need to prohibit parking in the vicinity of that intersection to make the intersection safer than what presently exists.” Mr. McBride was directed to contact the neighbours prior to next Monday’s Council meeting. CITY OF KITCHENER DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES NOVEMBER 8, 2010 - 103 - CITY OF KITCHENER Councillor C. Weylie resumed the chair. 11. DTS-10-159 - FREEPORT SEWAGE PUMPING STATION AND FORCEMAIN - CLASS ENVIRONMENTAL STUDY REPORT The Committee considered Development & Technical Services Department report DTS-10- 159, dated October 27, 2010. Mr. J. Gemin, Aecom Canada Ltd. was in attendance to present the Class Environmental Study Report. Councillor Gazzola noted that option #5 for the forcemain, being the preferred option, goes through Hidden Valley. Mr. Gemin confirmed that it does go through Hidden Valley and it will skirt around the natural area; further, this proposed location has been agreed to by the Grand River Conservation Authority. He also advised that if the Region moves forward with the river road extension, the forcemain can be included in that location. Mr. Gemin suggested that the new pumping station can be constructed first, then the forcemain could be constructed five years later. Mayor Zehr questioned whether the City would be in difficulties if it does not construct a new pumping station, or if maintaining the existing pumping station simply means that there can be no more growth in this area. Mr. Gemin stated that a new pumping station is required to manage the existing situation. If the city wants more growth, noting can be done without the forcemain. Mayor Zehr requested that members of Council be provided with 2 charts from Mr. Gemin’s presentation, the first being a matrix of the ratings for each option considered in the study and the second outlining the cost of each option. On motion by Mayor C. Zehr- it was resolved: “That the Freeport Sewage Pumping Station and Forcemain Environmental Study Report (ESR) prepared by Aecom Canada Ltd., dated August 2010, be received; and further; That the Freeport Sewage Pumping Station and Forcemain Environmental Study Report (ESR) be filed with the Ontario Ministry of the Environment for the mandatory thirty (30) day review period as required by the Environmental Assessment Act.” PUBLIC HEARING MATTERS UNDER THE PLANNING ACT The Chair read aloud the following statement: “This is a formal public meeting to consider applications under the Planning Act. If a person or public body does not make oral or written submissions to the City of Kitchener before the proposed applications are considered, the person or public body is not entitled to appeal the decision to the Ontario Municipal Board and may not be added as a party to a hearing of an appeal before the Ontario Municipal Board.” 12. DTS-10-173 - AMENDMENT TO THE ADAPTIVE REUSE COMMUNITY IMPROVEMENT PLAN OP10/01/COK/TMW The Committee considered Development & Technical Services Department report DTS-10- 173, dated October 15, 2010, in which staff advise that this Community Improvement Plan was approved in 2005, the primary purpose of which is to provide a financial incentive, through the form of Tax Increment financing for developments that reuse existing buildings within the Central Neighbourhoods portion of the city. Section 4.10 of the CIP states that no incentives are to be given out for projects receiving building permits after December 31, 2010; however, Council can amend the CIP to extend the date, which is recommended in the report. CITY OF KITCHENER DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES NOVEMBER 8, 2010 - 104 - CITY OF KITCHENER 12. DTS-10-173 - AMENDMENT TO THE ADAPTIVE REUSE COMMUNITY IMPROVEMENT PLAN OP10/01/COK/TMW, CONT’D On motion by Councillor B. Vrbanovic - it was resolved: “That an amendment to the Adaptive Reuse Community Improvement Plan to extend the deadline date for final building permits be approve in the form shown in the ‘Proposed By-law’ dated October 15, 2010, attached as Appendix “B” to Development and Technical Services Department report DTS-10-172; and further, That staff undertake a review of the City’s development related incentive programs and Community Improvement Plans prior to the next City of Kitchener Development Charge Study.” 13.ADJOURNMENT On motion, the meeting adjourned at 8:05 p.m. Dianne Gilchrist Committee Administrator
