CITY OF KITCHENER
Heritage Kitchener met this date, chaired by Councillor M. Galloway, commencing at 4:05 p.m., with
the following members present: Ms. J. Armstrong, Ms. D. Kuehl and Messrs. F. Bishop, R. Dyck, Z.
Janecki, J. Kerr, K. Kirby, E. Lucy, J. Pavia and M. Stranz.
Others Present: Mr. J. Willmer and Ms. D. Gilchrist.
HERITAGE PERMIT APPLICATION 2003 -V-08 - 29 PERTH ROAD -
ST. MARY'S HERITAGE CONSERVATION DISTRICT
The Committee was in receipt of Heritage Permit Application 2003-V-08, dated March 24, 2003,
for 29 Perth Road, located in the St. Mary's Heritage Conservation District; requesting
permission to construct a detached garage in the year yard. Accompanying the application was
a petition signed by fourteen neighbours in support of the application.
The Committee was also in receipt of a memorandum from Mr. L. Benason, dated April 23,
2003, along with an extract from the District Plan providing guidelines for new garages.
Mr. J. Willmer displayed images of the property. Mr. A. Sibbik, property owner, was in
attendance to answer any questions the committee might have in this regard.
Mr. K. Kirby advised he attended the property, and has spoken with some of the neighbours, who
are in support of the application.
On motion by Mr. K Kirby
it was resolved:
"That Heritage Permit Application 2003-V-08 (29 Perth Road - St. Mary's Heritage
Conservation District) be approved, pursuant to Section 43 of the Ontario Heritage Act, to
permit construction of a detached garage in the rear year, as shown on the plans and
specifications submitted with the application.
HERITAGE PERMIT APPLICATIONS 2003-1V-09, 2003-1V-10 AND 2003-1V-11,
393 TILT DRIVE (STAUFFER LOG HOUSE)
The Committee was in receipt of three Heritage Permit Applications, 2003-1V-09, 2003-1V-10
and 2003-V-11 for 393 Tilt Drive, which is designated under Part IV of the Ontario Heritage Act.
The applications request permission for the following: replacing the asphalt roofing material
with No. 2 grade cedar shingles; replacing the windows within the existing window openings,
except the gothic style window in the front facade, with handmade 12/12 windows; and replacing
the deteriorating sill logs, on the west and south elevations.
The Committee considered a memorandum from Mr. L. Bensason, dated April 23, 2003, with
respect with these applications.
Mr. J. Willmer displayed images of the subject property, and noted that the property is
designated Part IV of the Ontario Heritage Act, and there is a Heritage Easement Agreement
registered on title.
Mr. E. Lucy provided a brief history of the restoration work undertaken by the owners on this
building, complimenting them on the care they have taken with respect to maintenance and
restoration of the historic building fabric. He spoke in support of the applications.
The Committee reviewed the material in the agenda package. Ms. D. Kuehl put forward a motion
to defer consideration of the application to the June meeting, and the owner be requested to
attend to answer questions, which was voted on and lost.
On motion by Mr. E. Lucy
it was resolved:
"That Heritage Permit Applications 2003-1V-09, 2003-1V-10 and 2003-1V-11 (39 Tilt Drive)
be approved, pursuant to Section 33 of the Ontario Heritage Act, to permit:

That the owner shall satisfy the City's Heritage Planner that the above alterations will be
completed in accordance with good heritage restoration principles."
HERITAGE PERMIT APPLICATION 2003-V-12 - 9 OAK STREET -
VICTORIA PARK AREA HERITAGE CONSERVATION DISTRICT
The Committee was in receipt of Heritage Permit Application 2003-V-12, dated April 1,2003, for
9 Oak Street, located in the Victoria Park Area Heritage Conservation District. The application
requests permission to construct a detached garage in the rear yard.
Mr. Stojcic, property owner, and his son, were in attendance and provided revised drawings of
the garage and the site plan.
The Committee was in receipt of a memorandum from Mr. L. Bensanson, dated April 23, 2003,
advising that two members of Heritage Kitchener, from the Victoria Park Area, have identified
several concerns with the application; the proposed garage would be attached to the house given
the location of the covered back porch; the scale of the garage is too large relative to the house;
use of concrete block would not be a sympathetic and compatible finish material.
Several members spoke in opposition to the proposed garage noting it would be eleven feet
longer and two feet wider than the existing garage, and would over build the lot.
On motion by Ms. J. Armstrong
it was resolved:
"That Heritage Permit Application 2003-V-12 (9 Oak Street - Victoria Park Area Heritage
Conservation District), for the construction of a detached garage, be refused, pursuant to
Section 43 of the Ontario Heritage Act; and further,
That the applicant be encouraged to re-apply for permission to construct a detached
garage more in keeping with the guidelines in the Victoria Park Area Heritage
Conservation District Plan."
HERITAGE PERMIT APPLICATION 2003-V-13 - 175 DAVID STREET -
VICTORIA PARK AREA HERITAGE CONSERVATION DISTRICT
The Committee was in receipt of Heritage Permit Application 2003-V-13, dated April 15, 2003,
for 175 David Street, located in the Victoria Park Area Conservation District. The application
requests permission to construct a detached garage in the year yard.
Mr. J. Willmer displayed images of the subject property, and the Committee was in receipt of a
memorandum, dated April 23, 2003, from Mr. L. Bensason, commenting on the application.
Mr. G. Baronette, property owner, was in attendance to answer any questions the Committee
might have in this regard.

On motion by Mr. Z. Janecki
it was resolved:
"That Heritage Permit Application 2003- V-13 (175 David Street - Victoria Park Area
Heritage Conservation District) be approved, pursuant to Section 43 of the Ontario
Heritage Act, to permit construction of a detached garage in the rear yard, as shown on
the plans submitted with the application."
HERITAGE PERMIT APPLICATION 2003-V-14 - 230 OREGON COURT (LOT 5,
REGISTERED PLAN 58M-230 - UPPER DOON HERITAGE CONSERVATION DISTRICT
The Committee was in receipt of Heritage Permit Application 2003-V-14, dated April 14, 2003,
requesting permission to construct a two storey single family dwelling and attached garage on
Lot 5, Registered Plan 58M-230, Oregon Court, located in the Upper Doon Heritage
Conservation District.
Mr. J. Kuiken of Charlston Homes, the applicant, was in attendance in support of the
application, and displayed samples of the types and colours of materials to be used in this
house.
The Committee was in receipt of a memorandum from Mr. L. Bensason, dated April 23, 2003,
explaining the application, noting that the required landscape easement has been installed in the
rear yard.
Mr. J. Willmer displayed images of the subject property and surrounding properties.
Mr. E. Lucy raised a concern with respect to the height of the house at 33 feet, noting the
houses on Doon Village Road are not as high. He was advised by Mr. Willmer that this height is
permitted in the zoning by-Law. Mr. Lucy noted that the height of 33 feet is consistent with other
homes recently approved for this area; however, he noted that it will be many years before the
landscape buffer will hide the roofs.
On motion by Mr. Z. Janecki
it was resolved:
"That Heritage Permit Application 2003-V-14 (230 Oregon Court, Lot 5, Registered Plan
58M-230 - Upper Doon Heritage Conservation District) for construction of a new single
family dwelling and garage, be approved, pursuant to Section 43 of the Ontario Heritage
Act, in accordance with the plans submitted with the application, and subject to the use of
the following building materials and colours:
· Brick
· Stucco
· Windows
· Alumipro
· Shingles
· Railings

HERITAGE PERMIT APPLICATION 2003-V-15 - 379 QUEEN STREET SOUTH -
VICTORIA PARK HERITAGE CONSERVATION DISTRICT
Mr. R. Dyck declared a pecuniary interest in this application as he is the architect for this project,
and did not participate in any discussion or voting with respect to this application.
Mr. Z. Janecki declared a pecuniary interest in this application as he is employed by the
applicant, and did not participate in any discussion or voting with respect to this application.

HERITAGE PERMIT APPLICATION 2003-V-15 - 379 QUEEN STREET SOUTH -
VICTORIA PARK HERITAGE CONSERVATION DISTRICT (CONT'D)
The Committee was in receipt of Heritage Permit Application 2003-V-15, dated April 23, 2003,
for the property municipally known as 379 Queen Street South, located in the Victoria Park
Area Heritage Conservation District. The applicant seeks permission for changes to an
approval previously given by Council to alter the building by constructing an addition, to allow
replacement of the stone base with brick, and to reduce the width of the stone sill under the
windows.
The Committee was in receipt of a memorandum from Mr. L. Bensason, dated April 23, 2003,
outlining the application.
Mr. Dyck explained to the Committee that he had attempted to find stone to match, but not
overpower the existing building, but was unable to do so.
On motion by Mr. F. Bishop
it was resolved:
"That Heritage Permit Application 2003-V-15 (379 Queen Street South - Victoria Park
Area Heritage Conservation District) be approved, pursuant to Section 43 of the Ontario
Heritage Act, to amend the specifications for an addition previously approved by Council,
by replacing the stone base with brick to match the addition, and by reducing the width of
the stone sill to the width of each of the first storey windows, all as shown on drawing PEI
SK2 dated 4/23/03."
DEMOLITION CONTROL APPLICATION - DC 03/02/W/CB - 35 & 39 WEBER STREET
EAST
The Committee was in receipt of the memorandum from Mr. L. Bensason, dated April 24, 2003,
advising that the City has received a Demolition Control Application seeking approval to demolish
the buildings municipally known as 35 & 39 Weber Street East. It is noted in the memorandum
that staff believe the owner intends to use the lands for vehicular parking. The memorandum
also notes that the properties are not designated under the Ontario Heritage Act, nor are they
listed on the Heritage Inventory; however, they may be of heritage interest. Staff requests
comments on these properties and the Demolition Control Application from Heritage Kitchener
prior to making a recommendation to Council.
Some information about the condition of these buildings, including the amount of existing original
architecture remaining, and some historic information on prior owners, was included in the
memorandum and additional information on the history of these properties was provided at the
meeting.
Although Committee members had varying views on the historic and architectural merits of these
properties, they generally agreed that demolition is premature given the owner has not presented
a redevelopment proposal for the property. The Committee discussed adding these properties to
the Heritage Inventory, but generally agreed that further historic and architectural research needs
to be undertaken prior to doing so.
It was generally agreed that the Heritage Planner be requested to undertake further research on
these properties, and the matter of adding these properties to the Heritage Inventory be
discussed further at the next meeting.
On Motion by Mr. F. Bishop
it was resolved:
"That with respect to Demolition Control Application DC 03/02NV/CB - 35 & 39 Weber
Street East - Planning staff be advised that Heritage Kitchener is opposed to the
demolition of these buildings; and further;

That the property owner be encouraged to incorporate these buildings into any re-
development of the property."
Mr. Z. Janecki left the meeting at this time.
CRITERIA FOR HERITAGE EASEMENT AGREEMENTS -
FORMATION OF SUB-COMMITTEE
It was noted that information related to developing criteria for entering into Heritage Easement
Agreements was distributed at the Committee's March meeting. Members were requested to
volunteer for a working group that would research this matter, and bring forward a
recommendation to the full committee.
Ms. J. Armstrong and Messrs. F. Bishop and R. Dyck volunteered to be on the working group.
NAMING GUIDELINES
An invitation has been extended by the Arts and Culture Advisory Committee to have
volunteers from Heritage Kitchener participate in a working group to develop a better way of
naming buildings and sites in the City. Councillor Galloway advised that the working group
would probably have 2 - 3 meetings. Ms. D Kuehl and Mr. K. Kirby volunteered for this working
group.
1021 DOON VILLAGE ROAD
Councillor M. Galloway advised that he has recently received several calls from prospective
purchasers of 1021 Doon Village Road, asking if this Committee would give an opinion as to
whether it would support demolition of the property. Councillor Galloway noted the property is
the birthplace of Homer Watson.
Following discussion it was generally agreed that a working group consisting of Mr. L. Bensason,
Mr. K. Kirby and Mr. E. Lucy investigate the historic facts of the property, and the building's
structural integrity, including requesting a Building Inspector to view the buildings, and report
back to the Committee and its June or August meeting.
11. CANCELLED MEETINGS
Ms. D. Kuehl and Mr. F. Bishop requested that in future ,Committee meetings not be cancelled.
If there are no Heritage Permit Applications to be considered, the meetings should be used as
education sessions, as most of the Committee's membership is new.
