N / ~o o~ J~ SUBJECT LANDS MARL RECOMMENDATION: That Zone Change Application ZC10/11/O/ATP (Old Huron Road, Hallman Construction Ltd.) for the purpose of changing the zoning from Agricultural Zone (A-1) to Residential Six Zone (R-6), on lands located on Old Huron Road as shown on the attached Proposed Zoning Map (Map No. 1), in the City of Kitchener, be approved in the form shown in the "Proposed By-law" dated January 26, 2011, attached to Report CSD-11-020. 3-1 Staff Re vrt I~ITCH~I~TE~ X011117]unrtySer~i[eSDepQr~menlt w~+w.kitthenerca REPORT: Planning Comments: The City of Kitchener has received an application to change the zoning on a parcel of land, shown on Appendix "B", from Agricultural Zone (A-1) to Residential Six Zone (R-6). The subject lands include a 0.21 ha parcel of land with frontage of 13.44 metres on Old Huron Road and a depth of 175.23 metres. The City's zoning boundary does not align with the property boundary and as a result, the subject lands also include a 0.01 ha remnant triangular parcel on adjacent lands. Both parcels are under the same ownership. The subject lands are a remnant parcel that is undevelopable until it is consolidated with adjacent lands. The owner is proposing to consolidate the subject lands with the lands located immediately to the west which are currently zoned Residential Six (R-6). This zone permits a variety of low density residential building types including single-detached, semi-detached and street townhouse units with a maximum permitted building height of 3 storeys. The subject lands are designated as Low Rise Residential in the City's Official Plan. The Low Rise Residential designation allows for a full range of housing types to achieve a variety of low density residential uses. The proposed zone change on the subject lands and consolidation with adjacent Residential Six (R-6) zoned lands will allow for comprehensive redevelopment that will ensure compatibility with the existing and proposed development in the surrounding area and conform to the Low Rise Residential designation in the Official Plan. Property Owner Comments The zone change application was circulated to all property owners within 120 metres of the subject property. No comments or concerns were received as a result of this circulation. Department/Agency Comments The application was circulated to internal City departments and appropriate commenting agencies and no concerns were identified. ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN: The proposed zone change is required prior to the redevelopment of the subject site and will align with the Kitchener Strategic Plan as it ensures the implementation of the Development community priority with comprehensive redevelopment that is consistent with Provincial, Regional and City planning policies. FINANCIAL IMPLICATIONS: No new or additional capital budget requests are expected with this recommendation. COMMUNITY ENGAGEMENT: Preliminary circulation of the zone change application was undertaken on November 24, 2010 to all property owners within 120 metres of the subject lands. Notice of the public meeting to be held by the Committee of Council Dealing with planning matters on February 28, 2011 will be advertised in The Record on February 4, 2011. The subject lands are a remnant parcel that is undevelopable. The applicant intends to consolidate the remnant parcel with the adjacent lands which are currently zoned Residential Six (R-6) to allow for comprehensive redevelopment in the future. Schedule No. 165 of Appendix "A" to By-law Number 85-1 is hereby amended by changing the zoning applicable to the parcel of land specified and illustrated as the Subject Area on Map No. 1, in the City of Kitchener, attached hereto, from Agricultural Zone (A-1) to Residential Six Zone (R-6). 2. Schedule No. 165 of Appendix "A" to By-law Number 85-1 is hereby further amended by incorporating additional zone boundaries as shown on Map No. 1 attached hereto.
