MINUTES OF THE REGULAR MEETING HELD JANUARY 18, 2011

Mr. A. Head, Vice Chair, called this meeting to order at 10:03 a.m.
This meeting of the Committee of Adjustment sitting as a Standing Committee of City Council was
called to consider applications regarding variances to the City of Kitchener Sign By-law. The
Committee will not make a decision on these applications but rather will make a recommendation
which will be forwarded to the Committee of the Whole and Council for final decision.
The Chair explained that the Committee's decisions with respect to sign variances are
recommendations to City Council and not a final decision. He advised that the Committee's
recommendations will be forwarded to City Council on Monday January 24, 2011 at 7:00 p.m., and the
applicants may register with the City Clerk to appear at the meeting if desired.

The Committee was advised that the applicant is requesting permission for 2 canopy signs on
either side of the drive-thru to have a distance of 3.04 m (10’) between the bottom of the sign
and grade rather than the required 4.3m (14.1’); and, permission for 6 fascia signs to extend
above the roof line by 0.46m (1.5’) whereas the Sign By-law does not permit
The Committee considered the report of the Planning Division, dated January 7, 2011, advising
that the applicant is requesting a minor variance to permit two canopy signs at the drive-thru to
have a distance of 3.04 m (10 ft) between the bottom of the sign and grade rather than the
required 4.3 m (14.1 ft) and, permission for six fasica signs to extend above the roof line by
0.46 m (1.5 ft) whereas the Sign By-law does not permit fascia signs to extend above the roof
line.
The first variance request is in regards to two fascia signs located on a canopy over a drive
through aisle. As per Section 680.10.4(c) of the Sign By-law the minimum sign clearance for
such signs is 4.3 m (14 ft) when located within 0.6 m (1.96 ft) of an area intended for vehicular
traffic. This is to ensure there is sufficient distance between a sign and vehicles travelling
beneath the sign. In this case, the sign is located on a canopy that is clearly visible to drivers
and the canopy would meet requirements of the building code. Staff is of the opinion that it
meets the intent of the by-law and can be considered minor.
In regards to the second variance, Section 680.10.3 of the Sign By-law states that “no fascia
shall project above the maximum elevation of the façade of the building, including any parapet

to which the fascia sign is attached”. The applicant is requesting relief from this regulation to
permit six fascia signs to project 0.46 m (1.5 ft) about the roof line of a new building. The signs
are a corporate standard for some new CIBC buildings, such as a previous variance request for
a CIBC building at 1188 Fischer-Hallman Rd.
The intent of this Sign by-law regulation is to ensure that signs will be aesthetically pleasing and
will not interfere with the overall appearance of a building façade or the surrounding
streetscape. For the subject building the applicant is proposing an elevation of 0.46 m above
the façade of the building which can be considered minor and meeting the intent of the by-law.
The Committee considered the report of the Region of Waterloo Transportation Planner, dated
December 29, 2010, advising that have no concerns with this application.
Mr. Aston advised the Committee that he has read the staff report and is in support of the
recommendation.

rather than the required 4.3m (14.1’); and, permission for 6 fascia signs to extend above the
roof line by 0.46m (1.5’) whereas the Sign By-law does not permit fascia signs to extend above

the roofline, on Block 4, Registered Plan 58M-490, 120 The Boardwalk, Kitchener, Ontario,
APPROVED,
subject to the following condition:
1. That the owner shall obtain sign permits for all signs approved in this application from the
City’s Planning Division.
It is the opinion of this Committee that:
1. The variance approved in this application is minor in nature.
2. This application is desirable for the appropriate development of the property.
3. The general intent and purpose of the Chapter 680 (SIGN) of the City of Kitchener
Municipal Code is being maintained on the subject property.
