BACKGROUND: On February 8, 2010 Council adopted Interim Control By-law 2010-032 to temporarily prohibit anything other than existing uses, on lands that are subject to the Southwest Urban Area studies. By-law 2010-032 is due to expire on February 8, 2011 and the Southwest Urban Area Studies are scheduled to be completed in June 2011. Extending By-law 2010-032 will enable the City of Kitchener to complete the Southwest Urban Area Studies in a timely manner. REPORT: Interim Control By-law 2010-032 was adopted following consideration of Report DTS-10-047 (attached) which outlines the rationale and the statutory basis for the by-law. An Interim Control By-law can have a maximum duration of one year and can be extended for a maximum period of one year, for a total maximum duration of two years. The reasons for adopting Interim Control By-law 2010-032 remain valid until the City has completed the Southwest Urban Area Studies. The Southwest Urban Area Studies are progressing well and remain on target to be completed in June 2011 with the adoption of implementing official plan policies. The next major milestone is consideration of a new community master plan for the Southwest Urban Area on February 28, 2011. Through the approval of this report, Council would be reaffirming its direction to staff to complete the studies as originally contemplated. The extension to the Interim Control By-law will continue to provide staff with the necessary “breathing space” to work on the studies and to complete the required master community planning. The Regional Municipality of Waterloo is the approval authority of the implementing official plan policies. The Region of Waterloo has committed to approving the implementing official plan policies within 1-2 months of adoption by Kitchener Council. Following the approval of the ë ó ï implementing official plan policies by the Region of Waterloo there may be no need for interim control by-law to remain in effect, in which case staff would recommend that the by-law be rescinded. ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN: The Southwest Urban Area planning initiative is an action item of Kitchener’s Growth Management Strategy (KGMS) which was developed in response to growth management priorities identified in Kitchener’s Strategic Plan. The Terms of Reference for this comprehensive planning process also addresses the critical elements for a healthy community that are outlined in the “Development” and “Environment” sections of Kitchener’s Strategic Plan. FINANCIAL IMPLICATIONS: No additional capital costs are anticipated with the implementation of the recommendation of this report. As usual, the City could incur additional legal costs if the recommended by-law were appealed. COMMUNITY ENGAGEMENT: There are no statutory notice requirements for interim control by-laws. Development interests participating in the Southwest Urban Area community planning process are well aware of the City of Kitchener’s intentions of extending By-law 2010-032. The Southwest Urban Area community planning process includes an extensive community engagement process. A statutory public meeting will be held prior to a Council decision on the implementing official plan policies.
