HomeMy WebLinkAboutFCS-11-038 - Committee of AdjustmentREPORT TO:Committee of the Whole DATE OF MEETING: March 7, 2011 SUBMITTED BY: Dianne Gilchrist, Secretary-Treasurer, Committee of Adjustment (2277) PREPARED BY: Dianna Saunderson, Administrative Clerk (2594) WARD(S) INVOLVED: 1, 3 and 7 DATE OF REPORT: February 18, 2011 REPORT NO.: FCS-11-038 SUBJECT: Fence Variance – 29 Perkell Place Sign Variances – 4592 King Street East, 455 University Avenue West, 235 Ira Needles Boulevard RECOMMENDATION: “That the application of Stephen & Susan Perrin (FN 2011-001 – 29 Perkell Place) requesting permission to alter an existing wooden privacy fence located in the front yard, such that the first section of the fence, starting at the front wall of the house, will have a height of 1.524 m (5’) to the top of the post plus a fence post cap, the middle section to the fence will have a height of 1.21 m (4’) to the top of the post plus a fence post cap and the third portion of the fence closest to the street, will have a height of .9144 m (3’) to the top of the post plus a fence post cap, rather than the permitted height of 0.9 m (2.95’), on Lot 67, Plan 841, 29 Perkell Place, Kitchener BE APPROVED Ontario,.” - and - “That the application of Suncor Energy (SG 2011-001 – 4592 King Street East) requesting permission to locate a fascia sign on the building such that the bottom of the sign will be 3.15m (10.33’) above grade rather than the required 4.26m (14’), on Part Lots 23 & 24, Beasley’s BE APPROVED. Broken Front Concession, 4592 King Street East, Kitchener, Ontario, ” - and - “That the application of Waterloo Catholic District School Board (SG 2011-003 – 455 University Avenue) requesting permission to erect an automatic changing copy sign 34m (111.54’) from a residential zone rather than the required 150m (492.12’), on Lot 34, German Company Tract, BE being Part 2, Reference Plan 58R-5557, 455 University Avenue West, Kitchener, Ontario, APPROVED . 1. That the owner shall obtain a sign permit for the sign approved in this application from the City’s Planning Division.” - and - í ó ï “That the application of Ira Needles Developments Limited (SG 2011-004 – 235 Ira Needles Boulevard) requesting permission to erect a ground supported sign with the copy “No Exit” that does not contain the address of the property; whereas ground supported signs must contain the address of the property on which they are located, on Part Lot 38, German Company Tract, 235 BE APPROVED Ira Needles Boulevard, Kitchener, Ontario, . 1. That the owner shall obtain a sign permit for this sign from the City’s Planning Division.” REPORT: The Committee of Adjustment met as a standing committee of City Council on Tuesday February 15, 2011, to consider four applications: one pursuant to Chapter 630 (FENCES) and three pursuant to Chapter 680 (SIGNS), of the City of Kitchener Municipal Code. These recommendations are being forwarded to you on behalf of the Committee of Adjustment for your consideration. ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN: Respecting Sign By-law and Fence By-law variances, the Committee of Adjustment operates as a standing committee of City Council, and as such represents efficient and effective government. FINANCIAL IMPLICATIONS: None COMMUNITY ENGAGEMENT: As directed by the Sign and Fence By-laws, a notice of applications is published in the Record 15 - 18 days prior to the Committee of Adjustment meeting at which the applications will be considered.
