SUBJECT:
AMENDMENT TO BY-LAW 2010-190, PRIVATE
PROPERTY PARKING BY-LAW
RECOMMENDATION:
That a by-law be enacted to amend By-law 2010-190, being a by-law to regulate the
parking of vehicles on private property, to extend the effective date of the By-law from
January 18, 2011 to February 15, 2011.
BACKGROUND:
By-law 2010-190, being a by-law to regulate the parking of vehicles on private property without
the owner’s consent, was enacted on November 15, 2010. The By-law includes an “effective”
date of January 18, 2011, at which time it would come into effect and the previous by-law
number 88-170 would be repealed.
REPORT:
The “effective date” time period is necessary to allow staff to apply to the Ministry of the
Attorney General for set fines under the new by-law, while being able to continue enforcement
of the existing by-law with its set fine schedule. However, staff have not yet received approval
of the set fines under the new by-law. As such, staff are proposing to extend the effective date
of the new by-law to February 15, 2011. Based on recent information received, staff understand
th
that the new set fine schedule should be approved shortly, although not by January 18. If the
time period is not extended, the existing by-law would be repealed without the ability to enforce
the new by-law with regard to private property parking concerns.
