SUBJECT:
APPOINTMENT OF TRIBUANL MEMBERS – LUCKY’S
WINGS BUSINESS LICENCE
RECOMMENDATION:
That a hearing be held under the authority of the Municipal Act, 2001, to determine
whether or not to grant and/or impose conditions as a requirement of obtaining a 2011
Place of Refreshment Class A licence with respect to a licence application for Lucky’s
Wings, 320 King Street W.; and,
That Councillors _______, _________, _______ and ________ (alternate) be appointed as
members of the tribunal; and further,
That notice be given for the hearing, to be held at Kitchener City Hall on April 4, 2011,
following which a report will be submitted to Council for its consideration.
BACKGROUND:
On January 24, 2011, Council adopted the recommendation of the Finance & Corporate
Services Committee that the application from Lucky’s Wings, 320 King Street W. for a 2011
Place of Refreshment business licence, be referred to a licensing hearing. At that time staff did
not have a date for the hearing therefore, no members of Council were appointed as the
Tribunal.

Since the January 24 council meeting, staff has worked on coordinating a date for the business
licence hearing with the many witnesses involved with this hearing. The one date that works for

all concerned and is within the June 30 deadline for the temporary licence issued to the
business is April 4, 2011.
Staff is requesting the appointment of 3 councillors plus 1 alternate as the Tribunal. It is
suggested that Wards 9 & 10 councillors and the Mayor not be appointed due to possible
conflicts of sitting on the Downtown BIA and/or any constituency issues that may exist or arise
regarding this business.
The meeting will take place at City Hall however, the exact room and time hasn’t yet been
determined. In all likelihood, the hearing will take place in the morning but members of the
Tribunal should be prepared schedule the entire work day. Notice of the location and time will
be sent to the appointed members of the Tribunal.
