SUBJECT:
AGREEMENT WITH MINISTRY OF TRANSPORTATION
RECOMMENDATION:
That the Mayor and City Clerk be authorized to execute an Authorized Requestor Agreement
with the Ministry of Transportation, subject to the satisfaction of the Office of the City Solicitor, to
obtain vehicle ownership information relating to by-law enforcement investigations.
BACKGROUND:
The City of Kitchener currently has an Authorized Requestor Agreement in place with the
Ministry of Transportation to obtain vehicle ownership information. This allows the City to
electronically access the Ministry’s vehicle ownership database in order to process parking
infraction notices (parking tickets).
This existing agreement specifies that the information obtained from the Ministry can only be
used for parking related by-law enforcement matters.
REPORT:
The Ministry recently developed a secondary agreement which would allow municipalities to
access vehicle ownership information relating to non-parking by-law violations. This requires a
new and independent agreement as opposed to revising the existing agreement. By-law
Enforcement staff feel that it would be beneficial to enter into this additional agreement as a way
of increasing the effectiveness of their enforcement operations including, for example,
abandoned or derelict vehicles. The new agreement is substantially the same as the existing
agreement.

Staff from Legal and By-law Enforcement are currently reviewing the draft agreement and will
arrange for its execution by the Mayor and City Clerk at the appropriate time.
ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN:
The proposed secondary agreement with the Ministry of Transportation supports the Foundation
of the Strategic Plan relating to Efficient and Effective Government.
FINANCIAL IMPLICATIONS:
There is a one time fee of $250, payable to the Ministry of Transportation, relating to the
processing of this agreement.
COMMUNITY ENGAGEMENT:
This agreement is an operational and administrative initiative and does not require a level of
community engagement.
