SUBJECT:
Opt-In Agreement with the Ministry of the Attorney General
RECOMMENDATION:
“That the Mayor and Clerk be authorized to execute the Opt-in Agreement with Her
Majesty the Queen in right of Ontario as represented by the Ministry of the Attorney
General with respect to collection and enforcement of defaulted parking fines provided
such agreement is satisfactory to the City Solicitor.”
BACKGROUND:
Parking tickets are issued for various parking infractions across the City. When the fines are not
paid as required by law, the City uses plate denial to facilitate fine collection. The Ministry of
Transportation does not allow a person to obtain a new validation sticker for the licence plate of
their motor vehicle until certain defaulted parking fines have been paid. The ability to collect
fines in this manner with the Ministry of Transportation’s assistance is an important enforcement
element with respect to parking offences.
REPORT:
The Ministry of the Attorney General has contacted the City and explained that to continue using
plate denials to enforce and collect parking fines, we are required to enter an opt-in agreement.
The new agreement is intended to replace any current arrangements or agreements with the
Ministry respecting plate denial. Staff has reviewed the agreement and is working with the
Ministry of the Attorney General to ensure that the agreement is worded in a manner that allows
us to successfully implement its requirements.

FINANCIAL IMPLICATIONS:
In accordance with legislation, the administrative fees associated with plate denial are generally
added to the defaulted fines and collected from the person in addition to the outstanding fine
amounts. This agreement does not change the current financial arrangements respecting plate
denials.
