Gilchrist, Committee Administrator 1.CSD-11-063 - AMENDMENTS TO CEMETERY BY-LAW The Committee considered Community Services Department report CSD-11-063, dated April 26, 2011, in which staff recommends minor revisions to Chapter 210 (Cemeteries-Municipal) of the City of Kitchener Municipal Code. On motion by Councillor B. Ioannidis - it was resolved: “That a by-law be enacted to amend Chapter 210 (Cemeteries - Municipal) of the City of Kitchener Municipal Code, for housekeeping purposes, as outlined in Community Services Department report CSD-11-063; and further, That the amending by-law be forwarded to the Registrar appointed pursuant to the Cemeteries Act (Revised) for approval.” 2.CSD-11-057 - DEMOLITION CONTROL APPLICATION DC11/03/G/MV - 744 GLASGOW STREET - CHRISTINA FIORENZA The Committee considered Community Services Department report CSD-11-057, dated April 15, 2011, in which staff recommends conditional approval of a Demolition Control Application for 744 Glasgow Street, to allow for the demolition of a single family dwelling. On motion by Councillor B. Ioannidis - it was resolved: “That Demolition Control Application DC11/03/G/MV requesting permission to demolish one (1) single detached dwelling located at 744 Glasgow Street, owned by Christina Fiorenza, be approved with the following conditions: 1) That the owner obtains a building permit for the proposed residential dwelling unit; and, That upon satisfaction of condition 1, the Chief Building Official may authorize and issue a demolition permit under Section 33(6) of the Planning Act subject to the following condition: In the event that construction of the new dwelling unit is not substantially complete within 2-years of the date of issuance of the demolition permit, the City Clerk may enter on the collector’s roll, to be collected in like manner as municipal taxes, $20,000 for each dwelling unit contained in the residential properties in respect of which the demolition permit is issued and such sum shall, until the payment thereof, be a lien or charge upon the land in respect of which the permit to demolish the residential property is issued.” COMMUNITY AND INFRASTRUCTURE SERVICES COMMITTEE MAY 2, 2011 - 36 - CITY OF KITCHENER 3.CSD-11-059 - DEMOLITION CONTROL APPLICATION DC11/05/K/MV - 3247 KING STREET EAST - PINERIDGE DEVELOPMENTS INC. The Committee considered Community Services Department report CSD-11-059, dated April 19, 2011, in which staff recommends approval of a Demolition Control Application for 3247 King Street East, to allow for the demolition of a single family dwelling. On motion by Councillor B. Ioannidis - it was resolved: “That Demolition Control Application DC11/05/K/MV requesting permission to demolish one (1) single detached dwelling located at 3247 King Street East, owned by Pineridge Developments Inc., be approved.” 4.CSD-11-047 - NOISE EXEMPTION REQUEST - WESTHEIGHTS COMMUNITY CHURCH The Committee considered Community Services Department report CSD-11-047, dated April 20, 2011, in which staff recommends approval of an exemption from Chapter 450 (Noise) of the City of Kitchener Municipal Code for Westheights Community Church on June 12, 2011, for their annual outdoor carnival. On motion by Councillor B. Ioannidis - it was resolved: “That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to the Westheights Community Church at 82 Westheights Drive, for their annual outdoor carnival to be held on June 12, 2011, between the hours of 3:00 p.m. and 9:00 p.m.” 5.FCS-11-094 - OPT-IN AGREEMENT - MINISTRY OF ATTORNEY GENERAL The Committee considered Finance and Corporate Services Department report FCS-11-094, dated April 20, 2011, in which staff recommends approval of an agreement with the Ministry of the Attorney General with respect to collection and enforcement of defaulted parking fines. On motion by Councillor B. Ioannidis - it was resolved: “That the Mayor and Clerk be authorized to execute the Opt-in Agreement with Her Majesty the Queen in right of Ontario as represented by the Ministry of the Attorney General with respect to collection and enforcement of defaulted parking fines provided such agreement is satisfactory to the City Solicitor.” 6.CSD-11-065 - NOISE EXEMPTION REQUEST - FOREST HEIGHTS COLLEGIATE The Committee considered Community Services Department report CSD-11-065, dated April 27, 2011, in which staff recommends and exemption from Chapter 450 (Noise) of the City of Kitchener Municipal Code for Forest Heights Collegiate for their fundraising event to take place thth from 7:00 p.m. on June 10 to 7:00 a.m. on June 11 , 2011. On motion by Councillor B. Ioannidis - it was resolved: “That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to Forest Heights Collegiate Institute for an overnight event, to raise funds for mental health awareness, to be held between the hours of 7:00 p.m. on June 10, 2011 and 7:00 a.m. on June 11, 2011, provided that no amplified music is played after 11:00 th p.m. on June 10.” COMMUNITY AND INFRASTRUCTURE SERVICES COMMITTEE MAY 2, 2011 - 37 - CITY OF KITCHENER 7.CSD-11-066 - NOISE EXEMPTION REQUEST - CALVARY MEMORIAL UNITED CHURCH - 91 GRUHN STREET The Committee considered Community Services Department report CSD-11-066, dated April 27, 2011, in which staff recommends an exemption from Chapter 450 (Noise) of the City of Kitchener Municipal Code for Calvary Memorial United Church on June 25, 2011 for their Annual Strawberry Social. On motion by Councillor B. Ioannidis - it was resolved: “That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to the Calvary Memorial United Church on Saturday June 25, 2011, between the hours of 1 p.m. and 4 p.m., for their Annual Strawberry Social.” 8.CAO-11-008 - SAFE AND HEALTHY COMMUNITY ADVISORY COMMITTEE - 2011-2012 WORK PLAN The Committee considered Chief Administrator’s Office report CAO-11-008, dated May 2, 2011, in which staff presents the proposed 2011-2012 work plan for the Safe & Healthy Community Advisory Committee. Ms. S. Adams introduced this report and Ms. S. Weare reviewed the proposed work plan. Councillor Gazzola commented that the majority of the work plan focuses on the downtown. Ms. Weare responded that it is important to focus on people’s perceptions of downtown. She advised that one of the events proposed is a Jane’s Walk in downtown Kitchener, after dark. This walk will take place on Saturday May 7, 2011, starting in Civic Square at 7:00 p.m. and it will address the perceptions and reality of safety in downtown Kitchener. Ms. Weare advised that Jane’s Walks have been taking place since 2007 and they are organized by people who are passionate about their community. Further, community building in downtown will help with community safety. It is a way of preventing crime through development. With respect to a question of duplication, Ms. Weare advised that the Safe & Healthy Community Advisory Committee is attempting to support other jurisdictions and organizations. Respecting comments regarding the concentrated focus on the downtown, Ms. Adams advised that the Committee will be working with all neighbourhood associations. On motion by Councillor B. Ioannidis - it was resolved: “That the Safe and Healthy Community Advisory Committee Work Plan (2011-2012), as attached to report CAO-11-008, be approved.” 9.CSD-11-060 - KITCHENER PUBLIC LIBRARY ART PROJECT The Committee considered Community Services Department report CSD-11-060, dated April 14, 2011, in which staff recommends the work of public art for the expanded main branch of the Kitchener Public Library. Ms. C. York presented this report advising that this was a two-stage competition and there were 53 submissions. The installation is anticipated to take place in January 2013 in the new two-storey atrium. The material used for this work is Roscolux which is a combination of plastic and polyester and it will be printed as though book pages. The artist will work with the architect to choose appropriate colours. Councillor Gazzola left the meeting at this time. Some committee members commented on the cost of this installation. Mayor Zehr noted that this art installation complies with Council’s policy. Mr. Chapman advised that public art is included in all of the City’s major construction projects, as per Council’s policy. The cost was included in the project budget which has already been approved and part of the cost will come COMMUNITY AND INFRASTRUCTURE SERVICES COMMITTEE MAY 2, 2011 - 38 - CITY OF KITCHENER 9.CSD-11-060 - KITCHENER PUBLIC LIBRARY ART PROJECT, CONT’D from the Economic Development Investment Fund. Mr. Chapman also confirmed that the $150,000 cost is within the approved budget. Councillor P. Singh brought forward a motion to approve the staff recommendation which was Carried on a recorded vote as follows: Mayor C. Zehr and Councillors D. Glenn-Graham, B. Ioannides, Z. Janecki, K. Galloway, B. Vrbanovic and F. Etherington voting in favour; and, Councillors Y. Fernandes, S. Davey and P. Singh voting in opposition. On motion by Councillor P. Singh - it was resolved: “That the commission and installation of artwork at the Kitchener Public Library, titled “Flux”, be approved; and further, That the Mayor and Clerk be authorised to execute an agreement, satisfactory to the City Solicitor, with Edward Lam and Deborah Moss outlining the obligations of the library public art commission.” Councillor Gazzola re-entered the meeting. 10.CSD-11-062 - TEMPORARY OCCUPANCY REQUEST - 28 BLOOMINGDALE ROAD - DAVID AND DENISE SCHOTT The Committee considered Community Services Department report CSD-11-062, dated April 11, 2011, in which staff recommends conditional approval of the temporary occupancy of 28 Bloomingdale Road for a personal service use and a contractor’s/tradesman’s office. Ms. D. Ross presented this report advising that the property is currently zoned E-1 because of its location in the floodplain. For this reason staff has taken guidance from the Grand River Conservation Authority and is in support of the zone change. She advised that the uses exist on the property; the personal service use requires an occupancy permit, which is why the owner applied for this zone change. Further, this situation came to light through by-law enforcement. On motion by Councillor S. Davey - it was resolved: “That temporary occupancy of the buildings on the property addressed as 28 Bloomingdale Road for personal services and a contractor’s/tradesmen’s establishment uses be approved, subject to the following conditions: a) That enforcement of the City’s Zoning By-law be waived with respect to the personal service and contractor/tradesmen’s establishment uses existing as of May 2, 2011; and, b) That the personal service and contractor/tradesmen’s establishment vacate the site in the event that Zone Change application ZC11/05/B/EB, to add these uses by means of a Special Use and Regulation to the Existing Use (E1) zoning on the subject property, is refused; and, c) That in the event of failure to vacate, the City’s Municipal By-law Enforcement Officer be directed to commence notice of action to remove the personal service and contractor/tradesmen’s establishment uses and that any work done to the premises be at the sole risk and responsibility of the owner in the event losses are incurred as a result of the final disposition of Zone Change application ZC11/05/B/EB; and further, d) That all businesses functioning on the premises obtain a Certificate of Occupancy in the event that Zone Change application ZC11/05/B/EB is approved without appeal.” COMMUNITY AND INFRASTRUCTURE SERVICES COMMITTEE MAY 2, 2011 - 39 - CITY OF KITCHENER 12.
