BACKGROUND: The contribution agreements for the Infrastructure Stimulus Fund projects and Recreation Infrastructure Canada Fund projects obligate the City to submit signed Solemn Declaration of Substantial Completion certificates for each project. The agreements originally required these certificates to be signed by an architect or engineer. However, the Ontario Association of Architects ("OAA") and the Consulting Engineers of Ontario ("CEO") organizations have advised their members not to sign these certificates due to professional liability insurance concerns. Staff highlighted this issue in the last Council update report on stimulus projects (FCS-11-083). REPORT: Staff made a formal request to the Federal and Provincial governments to amend the wording of the Solemn Declaration Completion certificates to address the concerns originally raised by the OAA. The Federal government has changed the documentation requirements to address these concerns. The appropriate architect or engineer will provide documentation to the City outlining: • The date of substantial performance or contract deemed completed date; • A certificate for payment showing the monetary status of the project; and • A final general review stating that the project has been constructed in general conformity with the permit application documents noting any outstanding deficiencies or uncompleted work for architects or an inspection report (deficiency list) for engineers. 4-1 Staff Re~p~r~ I~~rc~~nT~~ Finance and Corporate Services 1~eparfinent w~+w.kitthenerca These documents will support the City's completion of the required Solemn Declaration Completion form. Project conformity with legislation outside of the architect or engineer's expertise will now be certified by the City. Staff therefore requests that Council authorize the Chief Administrative Officer to sign the Solemn Declaration of Substantial Completion Certificates for Infrastructure Stimulus Fund projects and Recreation Infrastructure Canada Fund projects as required.
