RECOMMENDATION:
That Tender T11-024, Herlan Avenue (Strange Street to Walnut Street) Walnut Street (Cherry
,
Street to Victoria Street South) Reconstruction, be awarded to Terracon Underground Ltd.
Brantford, Ontario
at their tendered price of $880,914.72, including provisional items and
contingencies of $158,746.00, plus H.S.T. of $114,518.91, for a total of $995,433.63; and
further,
That the Mayor and City Clerk be authorized to execute an agreement satisfactory to the City
Solicitor.
BACKGROUND:
Engineering Services wishes to proceed with the reconstruction of Herlan Avenue (Strange
Street to Walnut Street) and Walnut Street (Cherry Street to Victoria Street South). The
infrastructure has reached the end of its useful life and is in need of replacement. The services
were originally constructed around 1920’s. The sewers and watermains will be reconstructed to
meet current design standards. The project involves the replacement of the roadway, curb and
gutter and sidewalk and all underground services and surface works.
Full funding for this project has been approved by council as part of the 2011 budget process. A
surplus is projected in the project due to lower than anticipated construction pricing for the 2011
construction season. Construction budgets were increased as a result of high prices observed
throughout 2010, however the cost of construction which is a function of market forces, has
declined in 2011. The project is scheduled to begin July 4th, 2011, weather permitting, and is
located within the Ward 9 boundary.
REPORT:
Tenders were advertised publicly in The Record, the Daily Commercial News, on the City of
Kitchener website and the Internet through the Ontario Public Buyers Electronic Tendering

Information System. Ten (10) potential bidders picked up tender documents, and by the closing

date of April 28, 2011, Six (6) tenders had been received.

The tenders were reviewed by D. McLeod, McCormick Rankin Corporation, the City’s
Consultants for the project, and D. Lupsa, Project Manager, who concur with the above
recommendation.

FINANCIAL IMPLICATIONS:
Funding will be provided from cost centre Internal Order 7371, 52000578, 52000215, 52000216,
52000217, 52000218 – Reconstruction of Herlan/Walnut
Financial report is attached.
Budget estimate is $1,278.622.
Any surplus funds will be returned to Uncommitted (59500194) which are projects funded by
Sanitary Sewer (46%), Waterworks (31%) and Capital out of Current (23%).
