RECOMMENDATION:
That Expression of Interest E11-037, Consultant Services – 2011 & 2012 Stormwater Audit, be
Aquafor Beech Ltd., Guelph, Ontario
awarded to at their estimated fee of $78,870., including
contingencies of $7,170. plus H.S.T. of $10,253.10, for a total of $89,123.10, based on a
satisfactory contract being negotiated and an upset fee being established; and further,
That the Mayor and City Clerk be authorized to execute an agreement satisfactory to the City
Solicitor.
BACKGROUND:
The City of Kitchener SWM Policy has been developed through assessing the existing approach
to stormwater management, investigating options for modifying the current approach and
creating a strategy for a City-wide policy for stormwater. The purpose of this policy is to
streamline the current approach that often requires site-by-site stormwater management
measures. Limited opportunities at the site level often require individual oil-grit separators,
rooftop storage or similar single facilities. These small structures are difficult and/or expensive
to maintain and are usually on private property, and beyond the direct control of the City.
Concerns with regard to difficulties in maintaining these facilities led to the need to investigate
alternative approaches as adhered in the City of Kitchener’s SWM Policy.
The primary focus of the Policy is to address SWM needs for existing development areas and to
develop policies for infill and redevelopment areas accounting for both developed and
undeveloped lands. A recommended approach to stormwater management in the City of
Kitchener along with an implementation plan was developed to aid in determining required
stormwater features and monetary contributions (cash-in-lieu) related to the development and/or
redevelopment of any land within the City of Kitchener.
A phased approached is to be applied to the measures that will be implemented on a City-wide
basis. The phasing of these works will depend upon the location of development to occur and

the benefit that can be provided by the measures. The facilities are to be constructed in order of
priority which is based on providing the greatest protection and enhancements to the receiving
streams. The priority order has to be reviewed annually and modified as appropriate based on
the location of redevelopment/infill, the location of SWM measures implemented, and monitoring
results.
A city-wide monitoring program was recommended in the SWM Policy, to ensure that the
implementation plan is proceeding and that the elements are performing adequately.
Inadequate levels of performance should trigger actions to improve the situation.
During 2011, City staff has been directed to review the existing 2001 SWM Policy in light of the
new stormwater utility being implemented. The intent of the review will be to bring the 2001
SWM Policy in context with the existing funding mechanisms available for SWM and will be
conducted in conjunction with the development of a stormwater utility credit policy which aims to
create an incentive for property owners to implement best management practices and improve
the quantity and quality of stormwater that leaves their property.
REPORT:
In accordance with Chapter 170 of the Municipal Code pertaining to the Selection of
Professional Services/Consultants, a Consultant’s Review Committee was established
consisting of G. McTaggart, Manager, Infrastructure Asset Planning, M. Ryan, Design &
Construction Project Manager, B Steiner, Senior Environmental Planner, and L. Gordon,
Director of Supply Services.
Expressions of interest were advertised publicly in The Record, on the City of Kitchener website
and on the internet through the Ontario Public Buyers Association Electronic Tendering
Information System relative to this project. Documents were downloaded by twenty-nine (29)
interested parties, and by the closing date of Monday May 9, 2011, seven (7) responses had
been received.
The Review Committee met on Tuesday May 24, 2011, to review the submissions. The
submissions were rated on the following criteria: Qualifications and Experience, Proposed
Project Team, Completeness of Proposal, Effectiveness of Work Plan, Cost of Consultant’s
Fees, Knowledge of City, Permanent Local Office, and Amount of City Work Completed in the
Past. The Committee elected to award the project to Aquafor Beach Ltd., Guelph, Ontario.
