Gosse, Director of Legislated Services/City Clerk, 2809 PREPARED BY: Patricia Harris, Manager of Licensing, 2854 WARD(S) INVOLVED: All DATE OF REPORT: June 6, 2011 REPORT NO.: FCS-11-128 SUBJECT: REQUEST TO EXTEND THE SALE OF FIREWORKS TO JULY 2, 2011 RECOMMENDATION: That permission be granted to extend the sale of fireworks at all licensed fireworks vendor locations in Kitchener by one day to July 2, 2011. BACKGROUND: Chapter 739 (Fireworks and Firecrackers) of the City of Kitchener Municipal Code in Section 739.3.1 restricts the sale of fireworks in the City to the 6 business days immediately preceding Canada Day. It does allow for fireworks to be set off on the day immediately preceding or succeeding Victoria Day or Canada Day. REPORT: A request has been received from Mr. Shawn Miller requesting permission to extend the sale of fireworks at his location at King and River Road by one day to July 2, 2011. He is requesting this extension because Canada Day falls on a Friday this year and he would like to be able to sell his fireworks to the public who may wish to hold their displays on Saturday, July 2 instead of Canada Day. In order to provide an equal opportunity to all licensed fireworks vendors it is being recommended that permission for this extension be granted city wide. As the by-law does not currently permit sales after Canada Day, Council’s permission is required to allow for an extension. A similar request was granted by Council in 2006. The Fire Department has been contacted and they have no objection to this request.
