SUBJECT:
Fence Variance – 300 Joseph Schoerg Crescent
Sign Variance – 232 Bleams Road
RECOMMENDATION:
“That the application of Victoria Ariens (FN 2011-002 - 300 Joseph Schoerg Crescent)
requesting legalization of a fence (stone wall) having the height of 1.35m (4.43’) to be setback
2.51m (8.23’) from the driveway rather than outside the 4.57m (15’) driveway visibility triangle,
on Part Lot 12, Beasley’s Broken Front Concession and Part Block 12, Registered Plan 58M-
BE
400, being Parts 1, 3 and 4, Reference Plan 58R-15677, 300 Joseph Schoerg Crescent,
APPROVED,
subject to the following conditions:
1. That the applicant shall remove 2.0 metres of the existing driveway and reinstate 2.0
metres of soft surface materials to the satisfaction of the Director of Transportation
Planning.
2. That the applicant shall remove 0.51 metres of the existing driveway and install a 0.51
metre paving stone soldier course.”

“That the application of 1813124 Ontario Inc. (SG 2011-008 - 232 Bleams Road) requesting
permission for 2 directional ground supported signs to have a distance separation of 9.0m
(25.93‘) rather than the required 50m (164.04‘); and to have no address on the signs, whereas
the Sign By-law requires the address to be on these signs, on Lot 8, Plan 1482, 232 Bleams
BE APPROVED
Road, Kitchener, Ontario, , subject to the following conditions:
1. That the owner shall obtain a sign permit for this sign from the City’s Planning Division.”

REPORT:
The Committee of Adjustment met as a standing committee of City Council on Tuesday May 17,
2011, to consider two applications: one pursuant to Chapter 630 (FENCES) and one pursuant to
Chapter 680 (SIGNS), of the City of Kitchener Municipal Code.
These recommendations are being forwarded to you on behalf of the Committee of Adjustment
for your consideration.
ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN:
Respecting Sign By-law and Fence By-law variances, the Committee of Adjustment operates as
a standing committee of City Council, and as such represents efficient and effective
government.
FINANCIAL IMPLICATIONS:
None
COMMUNITY ENGAGEMENT:
As directed by the Sign By-law and Fence By-Law, notice of Applications for Variance to the
Sign By-law are published in the Record 15 - 18 days prior to the Committee of Adjustment
meeting at which the application will be considered. Notice of an application is also mailed to
property owners within 30m of the subject property.
