Gosse, Director of Legislated Services/city Clerk, 2809 PREPARED BY: Patricia Harris, Manager of Licensing, 2854 WARD(S) INVOLVED: 9 DATE OF REPORT: June 10, 2011 REPORT NO.: FCS-11-130 SUBJECT: REQUEST FOR MIDWAY AT RIBFEST – VICTORIA PARK – JULY 15-17, 2011 RECOMMENDATION: That GTA Midways Inc. be granted permission to operate a Midway in Victoria Park, during Ribfest from July 15-17, 2011 subject to the following: Hours of operation; and DateStartClose Friday, July 15 5:00 p.m. 10:00 p.m. Saturday, July 16 Noon10:00 p.m. Sunday, July 17 Noon6:00 p.m. That the music at the Midway be turned down at 8:00 p.m. ; and That the music be turned off one hour before closing time; and further That the required licence be obtained prior to operating the Midway. BACKGROUND: Council Policy I-920 requires that prior to the approval of an application for a midway location, the proposed site and details as well as the dates and hours of operation be brought before the Finance and Corporate Services Committee to allow an opportunity to address the potential concerns of residents. The applicant is required to notify residents within 120 metres of the proposed midway location that it will be operating, and the dates and hours of operation. REPORT: A request has been received from GTA Midways Inc. to operate a midway in Victoria Park during Ribfest. Similar requests were granted by Council in 2009 and 2010 when the midway was added to the Ribfest event to provide a further family friendly environment. In both years complaints were received regarding this event as well as many of the events that are held in Victoria Park. The complaints regarding the midway were about the noise created from the generators used to operate the rides. î ó ï In April 2011, the organizer of Ribfest and City staff met with the Victoria Park Working Group to discuss the event and attempt to provide solutions to alleviate concerns the residents near the park have. Through that dialogue, the Victoria Park Working Group was satisfied with the remedies that the organizer has suggested including the use of quieter generators to power the rides with the hope that this will solve the noise concerns. As per Council Policy residents within 120 metres of the midway have been notified and to date no concerns have been received. As directed in the by-law the Regional Health Unit and the City’s Traffic Division have been advised of this request. ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN: Community Priority – Dynamic Downtown The City’s goal is to provide events that will create urban vitality and attract more people to the downtown core. FINANCIAL IMPLICATIONS: None COMMUNITY ENGAGEMENT: Consult – Staff at GTA Midways have been supplied with the mailing labels to enable them to contact the area residents. Residents were invited to contact the Manager of Licensing prior to the Finance and Corporate Services Committee meeting to voice their concerns regarding the request for a midway.
