SUBJECT: ENCROACHMENT AGREEMENT REQUEST -PROPOSED
PROJECTING SIGN AND METAL SUPPORT BRACKET AT
30 ONTARIO ST S OVER ONTARIO ST S ROAD
ALLOWANCE
RECOMMENDATION:
"That, subject to obtaining all necessary approvals, the Mayor and Clerk be authorized to
execute an Encroachment Agreement, satisfactory to the City Solicitor, with the tenant or
property owner(s) and any mortgagee(s) of the property municipally known as 30 Ontario
St. S. (PIN 22427-0058) to legalize the proposed projecting sign and metal support
bracket which will encroach approximately 4', more or less, over the City's Ontario St. S.
road allowance."
BACKGROUND:
A potential tenant, Marisol Restaurante, at 30 Ontario St. S., would like to install a new sign for
a proposed restaurant. Currently Classico's Restaurant is operating in this location.
REPORT:
A request has been submitted by a potential tenant to operate a new restaurant, Marisol
Restaurante, located at 30 Ontario St. S. for the installation of a sign for their business. The
height of the proposed sign is 5' and the projecting sign and the metal support bracket that the
sign will be hung from will encroach approximately 4' over the Ontario St. S. road allowance.
The sign will be located approximately 9' high off the sidewalk. Attached is a sketch illustrating
the location and dimensions of the proposed sign and metal support bracket. A sign permit will
be required.
Due to timing of Council meetings, this matter is being brought to Council in advance of
obtaining all necessary staff approvals.

Community engagement is not necessary for this process. Internal staff and outside utility
companies are circulated for their comments and/or approval.
CONCLUSION:
Once all appropriate staff and outside utility companies reviews and approvals have been
obtained, it would be in order to authorize the execution of an encroachment agreement with the
tenant or property owner(s) and any mortgagee(s) of 30 Ontario St. S.
