The site has a total area of .21 hectares (0.51 acres), and at this time asingle-detached dwelling sits at the front of the property, with a building to the rear of the property that has been converted to house a hobby shop and two hair salons. The subject lands are located in an area mainly comprised of residential uses and general industrial uses. REPORT: The applicant wishes to add Special Use and Special Regulation Provisions to the subject site, to permit personal service uses, a single-detached dwelling, tradesman or contracting establishment, and manufacturing within the existing structures on the site. At this time, there are two personal service businesses and atradesman/contracting establishment (a hobby repair shop for street buggies) operating on site. A temporary occupancy request was made by the applicant and approved by Council at the meeting of May 9, 2011, allowing the personal services and tradesman or contractor's establishment use on the site until such time as a final decision is made on this zone change application. Provincial Policy Statement (PPS) The Provincial Policy Statement sets the policy foundation for regulating the development and use of land. With respect to natural hazards, the Policy Statement speaks to lands that are adjacent to rivers that are impacted by flooding hazards. The Policy Statement notes that where atwo-zone concept for flood plains is applied, as has been done on the subject site in the City of Kitchener Official Plan, development and site alteration may be permitted in those portions or hazardous lands and sites where the effects and risk to public safety are minor so as to be managed or mitigated in accordance with provincial standards. Staff is of the opinion that the proposed uses, subject to the restrictions in the proposed Special Regulation, will not create new hazards, aggravate existing hazards, or cause an adverse environmental impact and as such, the proposal is consistent with the Provincial Policy Statement. 2006 Growth Plan for the Greater Golden Horseshoe The subject lands are within the `built boundary' as defined by the 2006 Growth Plan for the Greater Golden Horseshoe. The Growth Plan promotes development that contributes to complete communities, creates street configurations that support walking, cycling and sustained viability of transit services and which creates high quality public open spaces. Staff is of the opinion that the proposal complies with the policies of the Growth Plan. Regional Official Policies Plan The subject lands are within the City Urban Area as established in the Regional Official Policies Plan, and staff is of the opinion that the proposal satisfies the policies of this plan. Kitchener's Official Plan The lands are designated as `Open Space' under the City's Official Plan, due to its location in a part of the Bridgeport neighbourhood identified as being atwo-zone flood plain policy area. The two-zoned flood plain is selectively applied to portions of the flood plain where significant development exists and could support further infill development with no adverse impact. The applicable Official Plan policies state that on lands zoned to recognize an existing use, a change in use may be permitted through a zone change provided that the subsequent use is compatible 2- 2 S~a~F Re opt ~ITCH~I`rTE~ ~011117]unrtyServi[eSDepQr~men~ www.kitthenerca with surrounding land use designations, no new dwelling units are created, the use presents less of a risk to life and property in the event of flooding, the new use is not prohibited by Part 2, Policy 7.4.1.2, and the appropriate permits are obtained from the Grand River Conservation Authority. A change in use will evoke a review of all existing outdoor storage areas. The proposed uses conform to the Official Plan. Current Zoning The subject lands are zoned `Existing Use Zone' (E-1). The Existing Use Zone only permits that use lawfully existing on and continually used for, since the date that the E-1 Zone was applied to the land, a use that is within the same type of use as the use lawfully existing on and continually used for, since the date that the E-1 Zone was applied to the land, a reduction in residential units for a residential use lawfully existing on, and continually used for, since the date that the E- 1 Zone was applied to the land, and a home business. The E-1 Zone does not permit any outdoor storage, even as an accessory use. Proposed Zoning City files indicate that at the time of the E-1 Zone being applied to the subject lands, the documented uses in operation were asingle-detached dwelling, a tradesman or contractor's establishment, and manufacturing. As the E-1 Zone requires that the use be continually underway, the cessation of the manufacturing use since 1994 means that a zone change is required in order to allow that use to be permitted again. Recently, two hair salons have begun operation on site. Adding this personal service use must also be done through the zone change process. To simplify future operational changes on site, staff are also making note of the single- detached dwelling and specific tradesman/contractor's establishment that is currently operating on site and existed at the time of the implementation of the E1 zoning. In the E-1 Zone, staff adds special use and special regulation provisions instead of changing the zoning category when uses or regulations are changed. In order to address comments from the GRCA during the agency circulation, staff is including limitations on the proposed uses that could pose a risk during a flood event. This includes a restriction on uses that depend on the storage, disposal, manufacture, transfer or treatment of hazardous substances. Further, no new dwelling units beyond the single unit existing would be permitted. Agency Circulation Agencies and departments were circulated the application. Copies of the comments received are attached as Appendix "D". ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN: This proposal is appropriate development for a healthy community, which is one of the community priorities in the City of Kitchener Strategic Plan. FINANCIAL IMPLICATIONS: No new or additional capital budget requests are expected with this recommendation COMMUNITY ENGAGEMENT: In accordance with Council Policy I-1170, there was no neighbourhood circulation. A copy of Council Policy I-1170 is attached as Appendix ""E". Notice of the August 15, 2011 public meeting of the Planning & Strategic Initiatives Committee will be advertised in The Record on July 22, 2011. A copy of the advertisement is attached as Appendix "B". 2-3 ~Tt~n>~~T~~ CONCLUSION: Staff Re opt CommunrtySer~ices Department www.kitchenerca In summary, planning staff is of the opinion that the proposed zone change is consistent with the PPS and maintains the intent of the Official Plan designation. The subject site is located in an area of light-industrial uses and residences, and staff are of the opinion that the proposed uses, as restricted by Special Regulation 571 R, will be compatible with the community. Staff also concludes that the addition of the personal service use on this site will not have an adverse impact or cause any additional safety concerns should a flood event occur. Schedule No. 136 of Appendix "A" to the By-law Number 85-1 is hereby further amended by incorporating additional zone boundaries as shown on Map No. 1 attached hereto. 3. Appendix "C" to By-law 85-1 is hereby amended by adding Section 412 thereto as follows: "412.
