HomeMy WebLinkAboutAdjustment - 2003-06-17 SG COMMITTEE OF ADJUSTMENT FOR THE CITY OF KITCHENER MINUTES OF THE REGULAR MEETING HELD JUNE 17, 2005 MEMBERS PRESENT: Messrs. P. Kruse, B. Isaac and D. Cybalski. OFFICIALS PRESENT: Mr. B. Sloan, Principal Planner and Ms. D. Gilchrist, Acting Secretary- Treasurer. Mr. P. Kruse, Vice -Chair, called this meeting to order at 9:35 a.m. This meeting of the Committee of Adjustment sitting as a Standing Committee of City Council was called to consider applications regarding variances to Chapter 680 (Signs) of the City of Kitchener Municipal Code. The Committee will not make a decision on these applications but rather will make a recommendation which will be forwarded to the Committee of the Whole and Council for final decision. The Chair explained that the Committee's decisions with respect to sign variances are recommendations to City Council and not a final decision. He advised that the Committee's recommendations will be forwarded to City Council on Wednesday July 2, 2003, at 7:00 p.m., and the applicants may register with the City Clerk to appear at the meeting if desired. MacDonald Contra: None Public Submissions: None The Committee was advised that the applicant is requesting permission to erect a pylon sign having a height of 9.144 m (30 ft.) rather than the permitted 7.5 m (24.6 ft.), and a sign area of 33.44 m2 (359.95 sq. ft.) per sign face, rather than the permitted 20 m2 (215.28 sq. ft.). The Committee was in receipt of correspondence from Ms. J. MacDonald, Candian Tire Real Estate Limited, dated June 5, 2003, requesting an amendment to this application to reduce the height of the pylon sign to 7.5 m (24.6 ft.); thereby comply with the height requirement in the City's Sign By-law. The Committee was in receipt of comments from the Development and Technical Services Department, dated June 9, 2003, in support of the amendment proposed by the Canadian Tire, and recommending the application be further amended to recognize that the proposed sign will COMMITTEE OF ADJUSTMENT 9 JUNE 17, 2003 Submission No.: SG 2003-007 (Cont'd) have no clearance beneath the sign face, and will have an area of 27.87 m2' They recommend approval of the amended application on the condition that revised sign drawings be submitted, and a sign permit be obtained. The Committee noted the written submissions of the following public agencies advising they have no comments on, or concerns with this application: · Grand River Conservation Authority, dated May 12, 2003 · Region of Waterloo Transportation Planner, dated May 13, 2003, and, · Ministry of Transportation, dated May 5, 2003. Isaac That the application of Voisin Developments requesting permission to erect a pylon sign having a sign area of 27.87 m2 (300 sq. ft.) rather than the permitted 20 m2 (215.28 sq. ft.), 0 m of clearance beneath the sign face rather than the required 2.44 m (8 ft.), with a solid obstruction within the required sign clearance on Part Lot 47, German Company Tract, 1400 Ottawa Street South (Northwest corner of Ottawa Street South and Fischer-Hallman Road), Kitchener, Ontario, BE APPROVED, subject to the following conditions: 1. Corcoran Contra: None Public Submissions: None The Committee was advised that the applicant is requesting permission to erect 6 awning signs having a height of 2.06 m (6.75 ft.), to be located 3.05 m (10 ft.) above grade rather than the required 4.27 m (14 ft.). The Committee considered the comments of the Development and Technical Services Department, dated June 6, 2003 recommending approval of the application. Moved by Mr. D. Cybalski Seconded by Mr. B. Isaac That the application of LCB© requesting permission to erect 6 canopy signs having a height of 2.06 m (6.75 ft.), to be located 3.05 m (10 ft.) above grade rather than the required 4.26 m (14 ft.) on Lots 52 - 57 & 60, and Part Lots 58 & 59, Registered Plan 786, 324 Highland Road West, Kitchener, Ontario, BE APPROVED, subject to the following condition: 1. That the applicant shall obtain a sign permit prior to erecting the signs. It is the opinion of this Committee that: 1. The variance approved in this application is minor in nature. 2. This application is desirable for the appropriate development of the property. 3. The general intent and purpose of the City of Kitchener Municipal Code Chapter 680 (Signs) is being maintained on the subject property.
